Pursuant to the Iowa Open Records Law, I hereby request the following records:

The number of deaths linked to the COVID-19 outbreak at each of the state's licensed nursing homes. This data is now already being released for case counts, which shows that the state has no legal issue releasing facility level totals. What is now released for cases, I asked be released for cumulative deaths, for all facilities in state. I ask that it be released in a machine readable electronic format, like a spreadsheet or text file of comma separated values.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

I would like to file a formal appeal.

Your office clearly must collect the data by facility in order to do the aggregation by facility type.

Also, your office has already provided case counts at the facility level, which demonstrates you do track data in this way. It also shows that these records have not been considered as shielded from release and therefore neither should the deaths.

Simply because you do not currently release the records on your website does not mean you cannot release in response to my request. In fact, allowing me to acquire and share this kind of information is purpose of the Iowa public records law. And the records I seek are clearly in the public interest, and released by other states.

For these reasons, I ask you to reconsider your rejection, and forward on my request for a formal legal appeal.
