Pursuant to the Oregon Public Records Law, I hereby request the following records:

A tabular data file containing all information collected in accordance with Oregon § 131.935 including but not limited to: date of stop, time of stop, race of driver, gender of driver, age of driver, if search occurred, if contraband was found, anonymized officer ID, and stop location for all years available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

At this time, the City is uncertain whether it is the custodian of the requested record.  The City will review your request to determine if it has responsive records.  The City will then gather an estimate of the costs to provide copies of requested public records for which the City does not claim an exemption from disclosure.  The City is permitted to charge its actual costs to provide records.  Fees include research time to locate and analyze the requested records, even if no records are located or if the requested records are determined to be exempt from disclosure.

The public records requested are exempt from disclosure and will not be provided.  The City asserts the following exemptions to disclosure:
Incident specific stops data is exempt per ORS 131.935 (6) - Data acquired under this section shall be used only for statistical purposes and not for any other purpose. The data may not contain information that reveals the identity of any stopped individual or the identity of any law enforcement officer. Data collected by law enforcement agencies or held by the Oregon Criminal Justice Commission under this section that may reveal the identity of any stopped individual or the identity of any law enforcement officer is exempt from public disclosure in any manner.

I waived the fee for this request.
Pursuant to ORS 192.329(2)(b) the City now considers your request fulfilled and it will be closed.  Please note, messages sent on closed requests will not be monitored.

I want to clarify that the data requested will be used purely for statistical purposes and are being collected as part of a research project by political scientists at the University of North Carolina, Chapel Hill and the University of Denver. We are not requesting individual identities or officer identities and they will be revealed or used for any other purpose beyond statistical analysis for this academic research study.

If you require any corroborating information about the nature of this research project and the institutions involved, please let me know what specific details or documentation you need. We are happy to provide any additional context to confirm this is a legitimate academic research endeavor with appropriate protocols in place to protect individual privacy and rights.
