- January 24, 2022: You demanded a fee of $1.25 for unspecified services (INV22-C073565-1)
- January 24: I notified you, same day, of intent to mail payment
- January 27: Check was in the mail
- January 31: Check was out for delivery
- February 23: You deposited check
- March 8: I requested status update on records I requested just a week shy of ONE YEAR prior

Dear Mr. Mocek. The email I sent may have been too big and unfortunately I missed that it did not go through properly. Here is the file that corresponds to the first $1.25 payment. I have uploaded it for you here as you have requested.
The payment dated March 23 is for the 2nd installment. Sorry for the delay.

From: Phil Mocek

To whom it may concern:

I received your unsigned clarifying message of March 28, 2022. Thank you for explaining what happened.

I received from you a single file, a ZIP archive named C073565_01_1.zip, which contains just two files:

Archive: C073565_01_1.zip
Length Date Time Name

--------- -------
1190869234 2 files

These are PDF files, sized 1.1 gigabytes and 66 megabytes. Am I to understand that the directory, "D:\LISTSERV\LISTS\FITLIST Weekly Private" on talk2.seattle.gov, contains these PDFs? It appears to me that instead of providing the requested records, someone has viewed them as email messages, then rendered the output to PDF, creating new records in the process, then sending those new, unrequested, and highly-obfuscated, records. This appears akin to the fabled discovery process whereby an entity who is required to turn over digital records, but wishes not to do so, sets out to comply with a court order in the least helpful method possible, by printing those digital records in a tiny font and delivering boxes and boxes of unsorted paper records.

For the sake of discussion, I will l give you the benefit of the doubt and assume that someone simply made a mistake, though I note that I am communicating with the IT department of the City of Seattle, so the idea that this situation can be attributed to incompetence or accident rather than malice is rather absurd.

Would you please provide a directory listing (i.e., list of files and subdirectories with timestamps and sizes, as returned by the Unix/Linux command `ls` or the Windows command `dir`? I recognize I did not request this initially, but I hope that in light of the extreme delay and of the unexpected format of the first installment of produced records, you can accommodate this informal request.

Phil Mocek

Dear Mr. Mocek,
I apologize for the delay in response. I am providing assistance to ITDs PDO due to an unexpected leave of absence.  Please consider this acknowledgment that your communications on 3/27, 3/28, and 4/24/2022 have been received and that I will provide a more complete response next week.
In the meantime, I see that you paid for your first installment via check.  Did you also send a check for the second invoice, INV22-C073565-2, created on 3/22? If yes, I will also work on confirming it was received.

Hello Mr. Mocek,
I am following up on my last communication from 5/6/2022.  My understanding is that the records provided for review were extracted and produced as .LOG files.  We were unable to view them in that format and found a workaround by opening them into Notepad and creating PDFs, which is what has been provided to you.  While I agree that this format is challenging to read and review, I can assure you that we are providing the records as they are.  If you are able to open .LOG files, I am happy to provide the native formats for the first installment.
In regard to your communication on 3/28 where you asked “Would you please provide a directory listing (i.e., list of files and subdirectories with timestamps and sizes, as returned by the Unix/Linux command `ls` or the Windows command `dir`? I recognize I did not request this initially, but I hope that in light of the extreme delay and of the unexpected format of the first installment of produced records, you can accommodate this informal request”, this has been included as part of this request. Please let me if you would prefer this to be treated as a new request.
Finally, I checked with our Accounting team and they could not find a record of payment for invoice INV22-C073565-2 created on 3/22/2022.  If you would let me know whether or not you mailed a check for that second invoice, I will try to track it down.  If I don’t hear back from you by May 20, 2022 regarding payment, I will consider this request closed.
Sincerly,
Arlinda Garcia

To whom it may concern:

I did not previously notice that a second invoice had been issued, as you sent it to me 1) obscured in a large amount of boilerplate language, and 2) before acknowledging my notification that I had paid the first invoice.

I will send the second payment right away.

I don't know just what the ".LOG flies" are, but if that's the native format, then that's what I asked for. I appreciate your effort to make those more useful, but in this case, PDFs tend to make the data more difficult to use.

Cordially,
Phil Mocek

Hello Phil Mocek,
Thank you for your response. Please remember that invoices are due 30 days after issuance.  As a courtesy, in this instance, we will give you an additional 10 business days to provide payment for  INV22-C073565-2 created on 3/22/2022.  Please let me know when you've sent your check so I can keep an eye out for it.  If payment is not received by June 7, we will consider the request closed.
In the meantime, I have added the native version of the installment you received at the end of March. To download your records, please:

* Navigate to the Public Records Request Center.
* Select 'My Records Request Center'.
* Select 'View My Requests'. You may be asked to login.
* Select this request: C073565-042221.
* Select the 'View Files' button.
* You can download records individually or all at the same time by clicking 'Download All'.
* Please save your records as you may only download them from the system three times. If you do not download your records within 30 days of request closure, the link to your records will expire.
If you believe you have received privileged or confidential records in error, please notify the City of Seattle immediately, through the Public Records Request Center or by email. Privileged or confidential records provided or received in error should not be reviewed, used, disseminated, distributed, or copied, and should be destroyed immediately. Thank you in advance for your cooperation.
