Pursuant to the Freedom of Information Act, I hereby request the following records:

The memorandum issued by former Chief Immigration Judge Tracy Short on or around April 25, 2022, which is referenced in this article: https://www.buzzfeednews.com/article/hamedaleaziz/deportations-biden-court-backlog-hold.

This memo is subject to disclosure under FOIA as a guidance document for agency staff members on how to process cases where the respondent has relief pending before USCIS. It is not protected by "attorney-client privilege" because it does not contain legal advice by an attorney for his client. Nor is it "work product" as it does not relate to any specific cases or matter that an attorney is working on. The document is a basic internal guidance document explaining how the agency will handle certain cases where there is relief pending before USCIS. It is protected by no exemption to the FOIA and should be released as a public record.

Finally, even if portions of this memo contain legal advice or work product, the agency should explain why it cannot redact those portions and release the remainder of the record.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. Although our firm practices before the Charlotte Immigration Court, the requested memo is a system-wide policy document, and the overriding public interest in such a document far outweighs any financial or commercial interest our firm may have (
