This is a request under the Freedom of Information Act. I hereby request the following records:
The processing notes for the release of the so-called 'first First General Council's Report' for the case against Crossroads GPS.
In releasing its decision to the public on January 10, 2014, the commission referenced an original First General Council's Report in footnote 111. This 'first First General Council's Report' was eventually released in the interest of transparency, but paradoxically was redacted in its entirety. I am seeking the notes generated in processing that document for release to the public.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Dear Mr. Richardson:
This email responds to your request for information from the
Federal Election Commission (FEC) under the Freedom of Information Act
(FOIA), dated June 11, 2015 and received in our office June 12, 2015. You
requested the following: ?The processing notes for the release of the
so-called ?first First General Council?s Report? for the case against
Crossroads GPS.?
The Agency has searched its records and identified one document
responsive to your request. However, your request for this document has
been denied subject to FOIA Exemption 5. FOIA Exemption 5 prevents
disclosure of ?inter-agency or intra-agency memorandums or letters which
would not be available by law to a party other than an agency in
litigation with the agency.? 5 U.S.C. § 552(b)(5). The document
(comprising two pages) you requested is subject to the deliberative
process privilege, and thus protected from disclosure by Exemption 5.
You may appeal any adverse FOIA determination. Any such appeal must be
filed in writing and should follow the guidelines set forth in 11 C.F.R. §
