Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Any 911 audio related to the Virginia Tech massacre on April 16th, 2007. This includes the “room 211” call audio from Norris Hall. If possible, please provide this audio in .wav or .flac format.

If any of this information is exempt under the Virginia Freedom of Information Act, please cite relevant exemptions where possible.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The materials you are seeking constitute records relating to a criminal investigation or prosecution” and would be contained in the criminal investigative files of the Virginia Department of State Police. Closed Criminal investigative files, and their contents, are excluded from the provisions of FOIA pursuant to § 2.2-3706.1(D) of the Act, “but may be disclosed by the custodian in his discretion.”  

The Department has considered your request and, pursuant to § 2.2-3704, elected to exercise its statutory discretion under § 2.2-3706.1 not to release the case file of documents and information, including, but not limited to, complaints, court orders, memoranda, notes, diagrams, maps, photographs, correspondence, reports, witness statements, and evidence in whole or in part.
