Pursuant to the Freedom of Information Act, I hereby request the following records:

I was aboard the USS Liberty when the ship was attacked by the IDF on June 8, 1967 and serve my shipmates as Historian of the USS Liberty Veterans Association.

The Report of the US Navy Court of Inquiry convened to look into all aspects of the June 8, 1967 attack on our ship contains a Finding of Fact claiming “Available evidence combines to indicate the attack on LIBERTY on 8 June was in fact a case of mistaken identity.”

We are requesting to be provided with all of the “available evidence” reviewed that supports that Finding of Fact.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is in response to your Freedom of Information Act request dated May
14, 2024, where you have requested a copy of the US Navy Court of Inquiry
into the Attack on the USS *Liberty* (AGTR 5) Your request was received by
the Reference Branch (RR2RR) on May 17, 2024 with the assigned tracking
number 24-42331.

We have searched our holdings in Record Group 38: Records of the Chief of
Naval Operations, Record Group 125: Records of the Judge Advocate General
(NAVY), and Record Group 457: Records of the National Security Agency, and
we were unable to locate the records you have requested.

In RG 38, which is where we have a section for the Naval Security Group
records, but these records are primarily relating to the cryptographic
efforts during World War II and did not include the Court of Inquiry.
There is a series that we have mentioned to you in the past Entry P 25:
Records of Attacks, Accidents and Other Topics, which has newspaper
articles/clippings about the attack, but not the Court of Inquiry.

In RG 125, in Entry P 2: Courts of Inquiries, there are a number of records
that go into the period of the 1960s and around the time of the attack on
the *Liberty*, but it does not include the Court of Inquiry on the *Liberty*.

In RG 457, in Entry A1 9002: Studies in Cryptography, there is a summary
report on the attack on the *Liberty*, but not the Court of Inquiry.

We would recommend that you either contact the Judge Advocate General
