Ms. Hill,
I have been assigned to your record request for "any and all documents that your agency retains regarding the 2016 Republican National Convention (RNC) held in Cleveland, Ohio. In particular, this request is for all records included but not limited to correspondence, memorandum of understanding (MOU), electronic data, e-mails, photographs, intelligence data, notes or other materials." This request is overly broad and vague. Please narrow your request so that I can identify the public records you are seeking. For example, you could provide a specific date or dates for the records you are requesting and/or identify the sender and/or recipient of the record.
Regarding your request for "memorandum of understanding (MOU)", I am interpreting this to mean the RNC Cooperative Agreement. I have redacted information from the Agreement that is not public record. Pursuant to Ohio Revised Code §149.43, if the City of Akron redacts information from a public record, the City must provide the person making the request with an explanation, including legal authority, setting forth why the information was redacted. The explanation provided does not preclude the City from relying upon additional reasons or legal authority in defending an action brought under R.C. §149.43(C). The City of Akron has redacted certain information from the Agreement that is a security record pursuant to Ohio Revised Code Section 149.433. The City of Akron reserves the right to deny public record requests for reasons not included herein in accordance with applicable laws.
Please contact me if the Agreement is not what you were looking for or to further clarify your request.
Sincerely,
Tammy L. Kalail
