I am following up with you regarding your Inspection of Public Records Act (“IPRA”) request submitted on February 27, 2023 (identified as # 23-1991).

We released a batch of records to you back on September 28, 2023. It appears you have yet to pick-up, pay for, or come in to inspect these records.

 

It appears that you no longer desire to inspect these records. If that is the case, then please send my office a written communication through Next Request # 23-1991 and indicate that you no longer wish to inspect these records and you also wish to have this request closed. If you are no longer interested in reviewing the public records, then we hope you are willing to extend that courtesy.

 

Please contact my office should you wish to set up an inspection. There is no cost to inspect the records in person. If you are unable or unwilling to inspect in person, or if you would prefer copies of the non-exempt responsive records – then under the law the City “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(C)(5). Prior to copying and mailing the records, my office will require advance payment of the copying fees ($0.50 per page) as well as the costs associated with mailing the set of documents to you. See NMSA 1978, § 14-2-9(C)(4) (“may charge the actual costs associated with transmitting copies of public records by mail”). 

 

Please respond to my office within one (1) week of this communication (11/23/2023). If you do not respond to this communication within that time and if you fail to come in to inspect the records within the next one (1) week, then my office will be forced to close out your request. Even though your inactions may force my office to close this request, you are always welcome to resubmit a new request in the future. We hope you understand the predicament your inactions have placed us, we only have a finite amount of time and resources and it would be a disservice to the Citizens of Albuquerque to spend it on a request where the requester has failed to respond to our communications and also failed to inspect the records made available.

Additional information was redacted and some records fully exempted. NMSA 1978, § 14-2-1(L) (as otherwise provided by law), including 34 U.S.C. § 40706 (federal DNA identification); New Mexico Constitution Article II, Section 24 (Rights of Crime Victims); NMSA 1978, Sections 31-26-1 to -16 (Victims of Crime Act); Section 29-16-8(A) (DNA Identification Act); NMAC 10.14.200.11(A)-(B)). I also redacted certain information which could reveal the identities of undercover police officers or informants. This information is exempt from the Inspection of Public Records Act. See NMSA 1978, § 14-2-1.2(A)(7) (confidential sources, methods or information). If made public, the redacted information would seriously interfere with the effectiveness of criminal investigations and prosecutions, and endanger undercover police officers or informants. I also redacted/exempted certain tactical information pursuant to NMSA 1978, § 14-2-1(I) (tactical response plans or procedures).

We released a batch of records to you back on March 28, 2024. It appears you have yet to pick-up, pay for, or come in to inspect these records.

 

It appears that you no longer desire to inspect these records. If that is the case, then please send my office a written communication through Next Request # 23-1991 and indicate that you no longer wish to inspect these records and you also wish to have this request closed. If you are no longer interested in reviewing the public records, then we hope you are willing to extend that courtesy.

 

Please contact my office should you wish to set up an inspection. There is no cost to inspect the records in person. If you are unable or unwilling to inspect in person, or if you would prefer copies of the non-exempt responsive records – then under the law the City “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(C)(5).
