Good Afternoon: The Anaheim Police Department ("APD") is in receipt of your recent Public Records Act ("PRA") request seeking "records related to the installation, approval and locations of automatic license plate readers from Motorola and Flock Safety" including "emails...copies of attachments....[and] copies of documentation of installations...and contracts related to the installations" from "2018-2023."
The APD may not have a document that identifies the exact compilation of information that you have requested and has no duty to create a record that does not exist at the time of the request. [Haynie v. Superior Court (2001) 26 Cal.4th 1061; 71 Ops.CalAtty.Gen. 235 (1988)]. Please note that certain records you have requested may be redacted or withheld pursuant to exemptions provided by the Public Records Act including, without limitation, the following:
• Records reflecting police security procedures are expressly exempt from disclosure pursuant to Gov. Code §7923.600 et seq.; and/or
• The records are subject to the public interest exemption (Gov. Code § 7922.000).
Without waiving, and subject to, the foregoing exemptions, the APD currently has cameras at the following locations:
