Pursuant to the Colorado Open Records Act, I hereby request the following records:

CAD Files, bodycams,dashcams and police reports mentioning a Jimmy Jones or 2002 Ford F250 without plates for the the following time spans:

October 2020
January 2021
February 2021
March 2021
April 1st 2021

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We are unable to process your request. To request records you must first complete a records request that is located on our website at https://archuletacounty.org/667/Records and pay the initial fee of $5.

Per CRS 24-72-306, a non-refundable research/retrieval fee of $5.00 will be assessed for every request to inspect public records, whether or not the requested record is located. Actual costs will include staff time for research, retrieval and redaction at $33.00 per hour. Electronic media such as Body Camera footage/picture is $15.00 per USB/DVD. The $5.00 initial fee will be applied to actual costs. (Redaction is the act of “blacking out” certain words or personal identifiers protected by law).

The initial fee covers the first hour of research and up to 10 pages. Additional pages are $ .25 per page and $33 per hour for research over the first hour.

Do you have a complaint or correspondence from the Attorney General? How often have you received complaints? Could I see them?

Has your office ever received a Writ of Mandus in regards to a FOI, CORA, CJRA request? Could I see those as well?

I am still processing my requests with the other offices to be able to clarify the search of the Jimmy files.

In response to your statement that the City is unable to locate any additional records responsive to my Colorado Open Records Act (CORA) request, please clarify which specific searches were conducted and confirm compliance with all obligations to locate responsive records, including all correspondence related to prior requests.

Given the time elapsed since my initial request and the City’s duty under CORA, I respectfully request a detailed explanation for this constructive denial, including the legal basis under CORA for the City's inability to locate these records.
