Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:
Copies of any email communications with the Office of the Governor, from January 1, 2016 to the present including the words: "BDS", or "HB 2617"
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Dear Ms. King,
A.R.S. § 39-121.01(D)(1), clearly allows the charging of a fee to cover the costs of hard copies of records to be mailed or for those being requested for non-commercial purposes, however the State's Attny General has issued an opinion stating that "If, for whatever reason, the public body must make a copy of a public record to properly provide the record to the requesting party for inspection, then charging a copying fee is not appropriate." In this case, as these email records are not otherwise publicly available, and there is no postage fee, and these are being used for non-commercial use I respectfully request that you waive the fees.
