Arkansas Parole Board Policies

To Whom It May Concern:

Pursuant to the Arkansas Freedom of Information Act, Ark. Code Ann. § 25-19-101 et seq., I request that the Arkansas Post-Prison Transfer Board (“the Board”) make the below documents available for copying or inspection.

1) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board to determine whether to issue an arrest warrant for an individual alleged to have violated the conditions of their release per Ark. Code Ann. § 16-93-705(a)(1)(A)(i).

2) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board regarding the appointment of attorneys for indigent individuals at parole revocation hearings per Code Ark. R. 158.00.1-3.9.

3) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board to determine which facilities are deemed suitable for the temporary detainment of individuals arrested for parole violations prior to their revocation hearing date per Ark. Code Ann. § 16-93-705(a)(3).

4) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board to determine when a parole revocation hearing may be held without first holding a preliminary hearing pursuant to Ark. Code Ann. § 16-93-705(e).

5) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board to determine when to schedule an individual’s parole revocation hearing subsequent to that individual’s arrest per Ark. Code Ann. § 16-93-705(c)(1)(A).

6) Please provide any and all internal policies, procedures, assessments, standards, or guidelines used by the Board to determine whether to take any of the following actions against an individual found to have violated a condition of their release per Code Ark. R. 158.00.1-3.6:

a) Returning the individual to supervision;

b) Imposing additional conditions of release;

c) Ordering placement in an Arkansas Division of Correction (ADC) facility;

d) Ordering placement in an Arkansas Department of Community Correction (ACC) Regional Correctional Facility (RCF);

e) Ordering placement in the Technical Violator’s Program (TVP); or

f) Utilizing an appropriate alternative to incarceration.

I ask that the Board provide the above records within three business days of receipt of this request, as required by Ark. Code Ann. § 25-19-105(e). I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. I also ask that the Board provide me with a fee estimate prior to fulfilling any request.

Should any part of the above request be denied, I request the Board provide a written response citing the specific statutory exemption, as required by Ark. Code. Ann. § 25-19-105(a)(3). If some of the above records are disclosable and others exempt, please provide the disclosable documents and provide the exemption(s) preventing disclosure of the rest per Ark. Code Ann. § 25-19-105(f). If any of the above documents are administratively controlled by a different custodian than the Board, I ask that the Board please provide those custodians’ information, per Ark. Code. Ann. § 25-19-105(a)(3)(C).
