Pursuant to the Arkansas Freedom of Information Act (“FOIA”), Ark. Code Ann. § § 25-19-101 to 25-19-109, I hereby request the following records:

The data record layout, data frame, or any equivalent data framework used by this agency to document maternal deaths. Materials responsive to this portion of this request should include reference to the data elements collected by this department and should not include any personal information. Please feel free to redact any personally-identifying information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

I am one of the attorneys for the Arkansas Department of Health (ADH). You have requested documents and data concerning maternal deaths , apparently pursuant to the Arkansas Freedom of Information Act (FOIA), in an email dated November 6, 2017 which also refers to a October 19th request which I have not received. However, it appears that you are a citizen of Massachusetts. You may wish to reflect on the United States Supreme Court case of McBurney v. Young , No. 12-17 , 569 U.S. _____, 133 S. Ct. 1709 (2013). The Supreme Court , in an unanimous decision , ruled that noncitizens of Virginia could not avail themselves of that state's FOIA law. Arkansas has a similar provision : (Arkansas Code §25 -19 -105(a)(1)(A)). Therefore, your request is denied.
