Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

For all email accounts under the management of this city, please provide me the following information for all emails sent and received during January, 2019:

1. From address
2. To address
3. bcc addresses
4. cc addresses
5. Time
6. Date

E-mail metadata is trivially exportable from the IT infrastructure of any modern e-mail archiving or data retention system - such as Microsoft Outlook 365, Google, Datacove, etc. - and should be deliverable in a .CSV, .XLS, or other machine readable format.

Please note that I am not requesting the contents of each email. E-mail metadata does not include the contents of the specified e-mails, thus do not need individual review for redaction.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Chapman:

 

Thank you for your request for information pursuant to the Illinois Freedom of Information Act, 5 ILCS 140/1 et. seq.  Under the Freedom of Information Act, a public body has five (5) business days to respond to a FOIA request.  However, the public body may extend the initial five (5) business day response time by up to five (5) additional business days for a limited number of reasons. 5 ILCS 140/3(e).  Please be advised that we are extending the time to respond to your request by an additional five (5) business days (ten (10) business days in total) to the date of February 13, 2019,  for the following reason:

 

 

__X__(ii)  The request requires the collection of a substantial number of specified records.

 

__X__(iii)  The request is couched in categorical terms and requires an extensive search for the records responsive to it.

 

__X__(v)  The requested records require examination and evaluation by personnel having the necessary competence and discretion to determine if they are exempt from disclosure under Section 7 of this Act or should be revealed only with appropriate deletions.

 

The City of Aurora reasonably expects the above-extended period of time to be sufficient time to assess the FOIA request and check the City of Aurora’s records to see if the request, or a substantial portion of the request, can be complied with within that time period.  The City of Aurora may need additional time beyond the ten (10) working days to fully gather all responsive records to the FOIA Request.  If additional time is needed beyond the ten (10) working day period, a representative of the City of Aurora will contact you to advise you of the need for additional time so that an agreement can be reached.

I've tried to call the office a couple of times to speak with you about this request because I'd really like to get it cleared up and get you the documents you need!  This request, specifically, #19-703, is actually a follow-up request to our request #19-410 (not #19-441) so there seems to be some confusion.  To attempt to avoid additional confusion, I'm going to close this request #19-703 as a duplicate request to #19-410 and continue to attempt to contact you through #19-410.  I did sent a request for you to narrow or confer to narrow your request in #19-410 and was hoping to get to speak with you about that.

On February 8, 2019, the City of Aurora sent you a letter indicating that your request was unduly burdensome (stating the reasons why) and offered you the opportunity to meet and confer regarding your request.  To date, I have not received a response from you and the 10 day time frame expired on February 22, 2019.  Instead of denying your request, I would really like to discuss this with you, however, if I don't receive a response from you prior to February 28th, I will be required to close your request as a denial.

Hi -

If I provided a list of email addresses that have already been released either through FOIA, or on an Illinois website (and therefore already deemed public for release), would you be able to limit the request to only include email addresses from that list? Excel can be used to filter the request - if needed, I can provide an Excel spreadsheet that can be used to filter the request based on such a list of email addresses.

On January 29, 2019, you submitted the following request to the City of Aurora:

On February 8, 2019, you were notified by the City of Aurora that your request was unduly burdensome and you were given the opportunity to meet and confer to narrow your request. Additionally, I have attempted to contact you via email and telephone regarding this request and have received no response from you.  Since you have not narrowed your request, the City is hereby denying your request as unduly burdensome. As previously specified the request is unduly burdensome because:

 

* The City completed a search of all emails sent/received by accounts under the management of the Cityduring the month of January, 2019. The search identified 706,066 emails that were sent to and from Cityemail accounts during the month of January, 2019. Although your request indicated that you believe ourresponse will not need to be reviewed for redaction, the City respectfully disagrees with that contention.Pursuant to 5 ILCS 140/2(c)(5), personal email addresses are specifically identified as “privateinformation” and, as such, considered exempt from inspection and copying pursuant to 5 ILCS 140/7(1)(b).Unfortunately, this means that an individual employee of the City of Aurora would, in fact, be required toreview 706,066 emails to determine if each involved email address is a personal or business email address.Your request is unduly burdensome because the employee responsible for reviewing and redacting theresponsive records would have to devote a significant amount of time solely to reviewing/redacting emailaddresses connected to 706,066 emails in order to respond to this request.

 

You have a right to have our determination and denial reviewed by the Public Access Counselor (PAC) at the Office of the Illinois Attorney General. 5 ILCS 140/9.5(a). You can file your Request for Review with the PAC by writing to:
