*** PUC Open Records Auto-Response. Please do not reply to this e-mail. ***
Thank you for submitting your open records request under the Public Information Act (PIA) to the Public Utility Commission of Texas (PUC). Your request has been forwarded to the PUC’s Public Information Coordinator. The Public Information Coordinator will address PIA requests in the order they are received, but in all cases within the time prescribed by law.
Time To Respond
We will promptly respond to your request by providing the requested information, informing you there is no responsive information, or notifying you all or a portion of the requested information falls under an exception to public disclosure and requires a ruling from the Office of the Attorney General (OAG). If the requested information does not fall under an exception to public disclosure but will take longer than 10 business days to produce, we will notify you of the date and time the information will be provided.
Request for Clarification
You can help us respond more quickly to your request by ensuring that your request is clear, specific, and requests only the information you wish to receive. We do our best to relate requests to the information we have and do not require records to be requested by their specific names, but if you know the specific name of the record you are requesting, it will help us respond more efficiently.
If your request is vague or overly broad, we may, in compliance with Texas Government Code § 552.222, request clarification in order to ensure we understand what information you are requesting. Also, please keep in mind that we are not required under the PIA to create new information, do legal research, or answer questions. See Open Records Decision Nos. 555 and 563 at https://www.texasattorneygeneral.gov/open-government/open-records-decisions.
Withholding Information
Although the PIA makes most government information available to the public, some exceptions exist. If we believe an exception applies, we will notify you that the information cannot be released and request a ruling from the OAG.
Costs
You may be charged for costs associated with responding to your request. Personnel time is charged at $15 per hour, plus 20% of the personnel charge for overhead. There is also a charge of $0.10 per page, plus personnel time, if the request exceeds fifty pages, plus postage. These rates are set by the OAG. You can find more information regarding costs associated with PIA requests here: https://texreg.sos.state.tx.us/public/readtac$ext.ViewTAC?tac_view=4&ti=1&pt=3&ch=70&rl=Y.
For more information regarding access to public information held by the PUC, please visit our website at https://www.puc.texas.gov/agency/about/contact/PIA.aspx.

You may also find more detailed information regarding the PIA in Texas Government Code Chapter 552 or on the OAG’s website at https://www.texasattorneygeneral.gov/open-government/members-public.

Hi Tessa,

Thank you for getting back to me for clarification. My answers to your questions are:

1. I'm seeking all closed requests, not just ones where an OAG ruling was sought.
2. I would like to know the name and institutional affiliation of the requestor, but I don't need their contact information. If the request includes personal information only available to the requestor, don't provide the responsive documents. Instead, just show the request and indicate that the response includes personal information.

Thank you!

From: Public Utility Commission Of Texas

Dear Mr. Manning,

Thank you for your response to the PUC’s clarification request.

As we prepare to gather the information responsive to your request, we would like to inform you that one requestor has asked that their personal information remain confidential. If you are interested in this information, we would need to request a ruling from the Office of the Attorney General so the requestor may submit their arguments as to why their information should be withheld.

You have indicated the only personal information you are interested in is the requestors’ names and institutional affiliation. Because of this, we will need to request a ruling on whether we must redact this one requestor’s remaining personal information (i.e., their name). However, if you are not interested in the name nor personal information of this one requestor, we can redact their name and provide you with the released information. Please note this requestor has no institutional affiliation listed in their request.

Please specify whether you are interested in the name of this one requestor.

You may send your response by email, mail, or in person to our office.

Thanks again for your help with my request.

Would you please estimate the cost to me of providing only the request, requestor (unless they request to remain private), and whether or not the ruling was approved? In other words, what would the cost be without providing the responsive documents?

If the cost is below $40 then please proceed with the less expensive approach. Otherwise, please let me know what the cost would be. Thank you Tessa!
