Pursuant to the Florida Sunshine Law, I hereby request the following records:

I hope this message finds you well. This is a public records request from a member of a media organization, pursuant to Florida Statute 119. In furtherance of an article investigating police misconduct payouts across the county over the past decades, we are seeking documents that show how much your municipal corporation, its legal representatives, or its liability insurance carriers have paid out in civil court since 01/01/2010 because of the actions of its police professionals.

To that end, we kindly request the electronic delivery of an excel spreadsheet with the following information:
- An identifying number for the claim
- The loss date
- An incident indicator description (such as “excessive force, k-9 bite, false arrest/imprisonment, etc.)
- Incurred expenses
- Incurred liability
- Incurred legal expenses
- Paid legal expenses
- Paid total
- Incurred total

This records pull should be interpreted to cover both federal and state court claims. If some of the above figures are not available because of your accounting practices, please endeavor to provide us with as full a picture as possible of the $$$ paid out by your municipality due to lawsuits against its police officers over the past ten years.

Upon request, we can provide a spreadsheet obtained from the BSO that can serve as an example and guide for what we are looking for. Please do feel free to reach out via email or phone should you have any questions.

We are in receipt of your public records request regarding:

Your request, in whole or in part, seeks disclosable public records that are in the possession of Bal Harbour Village. When a thorough search for requested records is complete, the records can be duplicated in their original format. If a cost is estimated to be incurred, we will contact you with an estimate before we begin completing the request. The copies of the records will be provided upon payment of the actual duplication and materials costs when applicable.

Duplication and Materials Costs
1. Records in paper format can be photocopied and mailed to you along with an invoice for the direct cost of duplication and shipping costs.
a. Legal Size or smaller, at $0.15 per page, $0.20 double-sided.
b. Greater than legal size, at actual cost of duplication.
2. Records in electronic format can be provided electronically by email or by an accessible link on line at no charge

Packaging and shipping charges apply to mailed records. Estimated costs may be changed to reflect actual cost incurred. You may also elect to pick-up the records at Bal Harbour Village Hall located at 655 96TH Street, Bal Harbour, FL 33154, at no additional cost.

Records Inspections
If review of the requested records is preferred, we will contact you once the records are gathered, to make an appointment for a mutually agreeable time for inspection of the documents. If the inspection time exceeds a half hour, a fee equal to the actual cost of the lowest paid employee capable of supervising the inspection will be applied. You may take photos with your personal device at no additional cost, or request copies with the duplication and material costs listed above being applicable.

Extensive Research Requests
If the research/copy time exceeds a half hour, a fee equal to the actual cost of the lowest paid employee capable of research/copying will be applied. If the time to complete your request is estimated to exceed a half hour, we will contact you with an estimate before we begin completing the request.

Records requested which contain confidential or trade secret information, may require legal review and could delay the release of requested records.

Reducing Costs and Limiting Charges
Labor costs can be reduced significantly if requests include keywords instead of open-ended terms such as “all documents or emails.” Similarly, narrowing a request to certain individuals or a particular date range can greatly reduce the use of extensive labor.

Non-Responsive Requestors
If a requesting party fails to respond to inquiries for clarification, cost estimates, or any other communication from the Village of Bal Harbour for 30 business days, the request will be closed. A non-responsive request may be resubmitted and will be processed as a new request.
