To Whom It May Concern:

Pursuant to the Maryland Public Information Act, I hereby request the following records:

Any records of arrests made during the years 2017, 2018, and 2019; of crimes being charged as human trafficking, including but not limited to, crimes of (1) involuntary servitude and (2) commercial sex trafficking. Additionally, please provide any demographic information related to the arrest that your agency may possess, including the age, gender, race, (and any other relevant fields) of the victims and the perpetrators. Additionally, please provide any available data on the time and locations of each arrest made.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Re: MPIA 19 1412 Human Trafficking

Dear Mr. Miles Anderson:

You have made a request for public records pursuant to the Maryland Public Information Act (MPIA), which is the General Provisions Article, § 4-101, et seq., of the Annotated Code of Maryland for "Human Trafficking Charges and Arrest Records."
Please see below in reference to your request:

* This is too general a request to be fulfilled, and involves cases currently undergoing adjudication. It also involves information regarding victims which may or may not be underage, and as such, are subject to redaction and protection under current Maryland law.
*Additionally, most of this information, including victim information, is protected under various state and federal Law and policy. Victims of human trafficking are almost never identified, and, even during adjudication purposes, can be protected.

*For merely statistical information, you can look at Polaris and the National Center for Missing and exploited children. Those statistics are public, without containing victim identifiers.

Therefore BPD must deny your request in its entirety. You have the right under PIA § 4-1B-04 to contact the Public Access Ombudsman to mediate any dispute(s) you may have with this response. You may also, contest this response by filing a complaint for judicial review in Circuit Court pursuant to PIA § 4-362.
Because neither I nor any employee of Legal Affairs are the Custodian of Records of the records you requested, I have no personal knowledge of the existence of any documents with the exception of those forwarded to Legal Affairs. Please refer to Tracking Number # MPIA 19-1412 in any subsequent correspondence in this matter.
