Pursuant to the Maryland Public Information Act, I hereby request the following records:

1. the total number of use of force incidents in 2022.

2. the total number of use of force incidents, separated by type of force, in 2022 (for example, information that specifies the number of taser incidents in 2022, baton incidents in 2022, etc.)

3. the total number of civilian complaints against law enforcement that were reported and the total number sustained for 2022.

4. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained for 2022.

5. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained for 2022.

6. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained for 2022.

7. the total number of officer-involved shootings in 2022, both fatal and non-fatal.

8. the total number of people who police used force against, broken down by race/ethnicity, in 2022.

When available, I would appreciate being sent individualized data in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is an acknowledgement of your request for public information submitted to the Document Compliance Unit (“DCU”) of the Baltimore Police Department (“BPD”). Your request is governed by the Maryland Public Information Act (“PIA”), Maryland Code, General Provisions Article (“GP”), Sections 4-101 et seq. DCU will attempt to process your request promptly. However, our response may take longer than ten (10) working days, the reasons for which may include the scope of your request, the type and volume of potentially responsive records, and the nature of the search, review, and preparation that is required. DCU will contact you with the availability of records and the possible costs associated with this request, as soon as the information is made available by the Custodian of Records. Likewise, if the DCU and/or the Custodian of Records need you to clarify your request, DCU will than contact.
Your request seeks Public Integrity Bureau’s (PIB) administrative disciplinary records recently made disclosable pursuant to Anton’s Law, S.B. 178 (2021 Session). Although we have not yet investigated the scope of your particular request, production of these records often involves expenditure of substantial resources in the search for, preparation of, and reproduction of responsive materials.
BPD will offer requestors of such records the option to receive the disciplinary history summary for each BPD member identified in the request in lieu of a comprehensive response to the request. These summaries provide an overview of all disciplinary investigations against the subject officer including the disposition of each, can be prepared more quickly than a full disciplinary file, and can be produced at little or no cost to the requestor. The summary may provide all of the information you seek, or may enable you to resubmit a more tailored request, thereby reducing the fee BPD charges to recover its costs in producing the materials you require.
Please respond to this email within 10 business days indicating whether you wish to receive disciplinary history summaries in lieu of your request as originally stated. This information is required for DCU to move forward with either 1) preparing an estimate of the cost associated with the production of the disciplinary history summary or 2) preparing an estimate of the costs associated with the production of records responsive to the full scope of your request. No further action will be taken by DCU until we receive your response. Please refer to tracking # MPIA 23-2054 in any subsequent correspondence pertaining to this matter.
