Pursuant to the Texas Public Information Act, I hereby request the following records:
I am requesting records concerning an incident where a Texas man assaulted an election clerk after he was asked to remove his red "Make America Great Again" hat at an early voting site, authorities said. Jesse Lutzenberger, 63, was arrested on Thursday and charged with injury to an elderly person, according to the Bexar County Sheriff's Office. He faces a third-degree felony, punishable by up to 10 years in prison and a fine of up to $10,000.
The incident occurred at about 6:30 p.m. Thursday at the Johnston Branch Library in southwest San Antonio, according to the Bexar County Sheriff's Office. Lutzenberger, who wore a red MAGA hat, entered the library and was asked by a 69-year-old early voting clerk to remove his hat, Bexar County Sheriff Javier Salazar said at a news conference Friday afternoon.
Specifically, I am requesting the following records, if they exist:
Incident Report: Any incident or police report(s) prepared in connection with this incident.
911 Audio: A copy of any 911 call recordings related to the incident, including any call placed by election workers, witnesses, or involved parties.
Radio Dispatch Recordings: Any police radio dispatch communications concerning the incident, including initial dispatch and subsequent communications related to the incident.
Body Camera Footage: All body-worn camera footage captured by responding law enforcement officers at the scene of the incident.
Computer-Aided Dispatch (CAD) Log: The CAD log detailing the sequence of events, including all times and actions taken by dispatch and responding units during this incident.
I request these records in their entirety unless there are specific exemptions that apply. If any portion of the records is subject to exemption, please provide redacted copies with the applicable exemptions identified.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
