Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

Related to district HVAC systems for the last five years:

Maintenance records
inspection reports
air quality tests
capital improvement reports for all district schools

As background, this request is filed as part of a journalism project looking at HVAC systems across schools in the United States, and similar requests are being filed in additional school districts.

If you have summary reports or other documents that are likely to include largely similar information and are easier to provide, I’m willing to accept those as a substitute.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please be advised that this is Birmingham Public Schools response to your FOIA request dated January 12. You requested the following documents:

Related to district HVAC systems for the last five years:

· Maintenance records

· inspection reports

· air quality tests

· capital improvement reports for all district schools

With regard to your request, please be advised that pursuant to MCL 15.235(2)(d), the School District must extend by ten (10) business days the period during which the School District will provide you with a substantive response to your request. This extension is necessitated by the extensive nature of your requests, and the need to search for, collect, collate, and appropriately examine and/or review a potentially voluminous amount of public records that may be responsive to your requests. An estimated fee has to be assessed for the information associated with your request and will be provided within this timeframe. Accordingly, no later than February 3, the School District will respond pursuant to MCL 15.235(6).

In response to your MIFOIA request received to the FOIA department on January 12, this will serve as Birmingham Public Schools’ response to your request for information on the solid waste and recycling services.

Request:

· Related to district HVAC systems for the last five years:

o Maintenance records

o inspection reports

o air quality tests

o capital improvement reports for all district schools

Response: The requested records are attached.

To the extent that your request for records has been denied, in whole or in part, you have the following rights of appeal under the Michigan Freedom of Information Act:

Appeal to the Superintendent of Schools. You may appeal the denial to the Superintendent of Schools for Birmingham Public Schools. Your appeal must include the word “appeal” and identify the reason(s) you believe the Superintendent should reverse the denial.

The Superintendent will respond to the appeal, in writing, within 10 business days. In the event of unusual circumstances, the Superintendent may extend the time for response by not more than 10 additional business days.

Appeal to Oakland County Circuit Court In addition to your right to appeal to the Superintendent, you may file a civil action in the Oakland County Circuit Court. If you prevail in such an action, you are entitled to an award of reasonable attorney fees, costs and disbursements. If you prevail, in part, the court may award all or an appropriate portion of reasonable attorney fees, costs and disbursements.

In addition to the above, if the court determines that Birmingham Public Schools has “arbitrarily and capriciously” violated the Michigan Freedom of Information Act in responding or failing to respond to your request, the court will order Birmingham Public Schools to pay:

• $1,000 in punitive damages to you, in addition to any actual or compensatory damages, and

• a fine in the amount of $1,000, which will be deposited in the Michigan Department of Treasury’s general fund.

• Please note that a civil action based upon a denial of public records must be filed within:

• 45 days from the date of the Superintendent’s decision concerning an appeal, or

• 180 days after Birmingham Public Schools’ denial of your request, if no appeal to the Superintendent was taken.
