I request all email communication between and among the DOC, DCAMM, EOPSS, and the Governor’s Office from August 1, 2020 to October 31, 2020 regarding Bay State Correctional Facility.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Public Records Unit,

This matter should not be considered closed because it is not a superseding duplicate request. Although "DOC2002" is a Mass. State Project Number which concerns the Bay State Correctional Facility, I am seeking emails that might reference the Bay State Correctional Facility without also mentioning that specific project. In other words, while emails regarding "Bay State Correctional Facility" and "DOC2002" are likely a Venn diagram with substantial overlap, there may be communications that fall under each individually that are not duplicative. As further evidence, DCAMM has since produced a new set of RFPs under different state project numbers - DOC2104 (https://www.mass.gov/doc/dsb-20-22-doc2104-statement-of-work-for-strategic-planning-consultant-20-1228/download) and DOC2106 (https://www.mass.gov/doc/dsb-21-01-study-and-design-of-a-correctional-center-for-women/download) - each of which either reproduces an RFP that was given state project number DOC2002 or which concerns the Bay State Correctional Facility but does not reference DOC2002. It is therefore clearly error to conclude that emails with each of these phrases would be duplicative, and each separately filed public records request must be honored in full as initially written.

Good afternoon,

We received your correspondence regarding request #21-04. While we understand your concern about the potential of missing certain records, please know we are conducting a search that we believe will identify records responsive to both 21-04 and 05. In the course of evaluating your requests, and in consultation with our IT partners, we developed a boolean search which is expected to identify all instances of “DOC2002” or “Bay State Correctional Facility” referenced in communications within our possession and control, thus capturing all records contemplated by request #s 21-04 and 21-05. By doing so, we believe we should be able to locate for you all communications represented by all three circles of your hypothetical Venn diagram. This also helps maximize our limited resources by avoiding redundancy in collection and review and ensures you receive the records sought. We apologize for not stating this approach more clearly when closing out 21-04. If you have further concerns, please don’t hesitate to contact us.
