As agreed to on our call this afternoon, I want to memorialize our discussion on the prosecution of our search for you. Going forward in processing your requests, we're going to segregate out email that can be characterized as operational or administrative in nature, as this is not the primary focus of your research. This would include emails relating to our internal project management system and processes as well as capital planning and budgetary correspondence which may include large spreadsheets listing all our projects and produce a considerable number of pages requiring review.

We understand your interest is in more substantive information on women's incarceration, prison conditions, physical plant and related plans. It is this material that is your immediate focus and will be the focus of our search. We also understand you reserved the right to review the segregated ministerial records at a future date, after you've had an opportunity to assess records we are able to provide.

Dear Ms. Roth:

The Division of Capital Asset Management and Maintenance (“DCAMM”) received your public records request dated January 4, 2021. You requested:

“all email communication between and among the DOC, DCAMM, EOPSS, and the Governor’s Office from August 1, 2020 to October 31, 2020 regarding “women’s incarceration” and/or “women’s corrections.””

Please note, a portion of the attached material was determined to be exempt pursuant to Massachusetts General Laws Chapter 4, Section 7(26)(n) which reads as follows:

Exemption (n) applies to: records, including, but not limited to, blueprints, plans, policies, procedures and schematic drawings, which relate to internal layout and structural elements, security measures, emergency preparedness, threat or vulnerability assessments, or any other records relating to the security or safety of persons or buildings, structures, facilities, utilities, transportation, cyber security or other infrastructure located within the commonwealth, the disclosure of which, in the reasonable judgment of the record custodian, subject to review by the supervisor of public records under subsection (c) of section 10 of chapter 66, is likely to jeopardize public safety or cyber security.

The redacted portion of the records include floor plans, internal layout and structural elements relating to the safety and security of persons and critical infrastructure as well as information on computer network resources, the very records which are the focus of the exemption. See People for the Ethical Treatment of Animals, Inc. v. Department of Agricultural Resources, 477 Mass. 280 (2017) at 289 (requiring a determination whether and to what degree the record sought resembles the records listed as examples in the statute).

The subject of your request relate to women’s correctional facilities in Massachusetts. Knowledge of floor plans, layout, structural elements, and security measures shared throughout the building, together with the location of certain key personnel, exposes the public, inmates and these valuable Commonwealth assets to threat actors and jeopardizes physical security. Likewise, knowledge of network paths and related technical resources exposes these valuable Commonwealth assets to threat actors and jeopardizes cyber security. It is therefore the determination of this office that disclosure of the redacted portions of the subject record is likely to jeopardize public and cyber safety and security.

Further, we are withholding certain correspondence pursuant the Deliberative Process Exemption set out at G.L. c. 4, § 7(26)(d) (“Exemption (d)”). The subject correspondence, on which policy position development is or may be based, is ongoing and therefore exempt from mandatory disclosure. Exemption (d) is intended to avoid release of materials that could taint the deliberative process if prematurely disclosed.

If you wish to challenge any aspect of DCAMM’s response, in accordance with G.L. c. 66, § 10 and 950 CMR 32.00, you may appeal to the following office: Supervisor of Public Records, Office of the Secretary of the Commonwealth, Public Records Division, One Ashburton Place, 17th Floor, Boston, MA 02108, and in accordance with G.L. c. 66, § 10A(c), you have the right to seek judicial review of an unfavorable decision by commencing a civil action in the Superior Court.
