Pursuant to the New York Freedom of Information Law, I hereby request the following records:

All audio recordings of 911 calls placed to the Buffalo Police Department on May 14, 2022 between the times of 2:00 PM (Local Time/EDT) until 4:00PM. The times are requested as Buffalo Local Time/EDT. Please include a spreadsheet or attachment that can act as a directory for the audio.

Please release the recording in WAV or MP3 format, whichever is easier.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The City of Buffalo Police Department (BPD) is in receipt of your Freedom
of Information Law request. Please allow this letter to serve as an
acknowledgment of your request pursuant to New York State Public Officer’s
Law, Section 89, entitled Freedom of Information Law.

The BPD has researched your request for information pertaining to all
dispatch calls 5/14/2022. In accordance with Public Officers Law §87
(2)(a), an agency is not required to disclose certain records that are
specifically exempted from disclosure by state or federal statute. One such
statute applicable to the records in question is County Law §308(4), which
states “records, in whatever form they may be kept, of calls made to a
municipality's E911 system shall not be made available to or obtained by
any entity or person, other than that municipality's public safety agency,
another government agency or body, or a private entity or a person
providing medical, ambulance or other emergency services, and shall not be
utilized for any commercial purpose other than the provision of emergency
services.” Please note that the information you are requesting may be
available with a judicial subpoena to be sent to Central Police Services,
45 Elm St, Buffalo NY 14203 for the audio of this call. 911 recordings are
held for a period of 3 years from date of occurrence. Please be advised
enclosed is a complaint list of all 911 calls from date and time frame
requested. Be advised that portions of the records have been redacted
pursuant to the Freedom of Information Law to remove identifying details
such as social security numbers, home addresses, and personal phones (see
Public Officers Law section 89[2][c][i]).

Please be advised that you have the right to appeal any denial contained
herein in writing within thirty (30) days. Appeals must be directed to
Corporation Counsel, City of Buffalo Law Department, 1100 City Hall,
Buffalo, NY 14202.
