2. the total number of use of force incidents, separated by year and type of force, from 2017-2022 (for example, information that specifies the number of taser incidents in 2022, baton incidents in 2022, etc.)
3. the total number of civilian complaints against law enforcement that were reported and the total number sustained from 2017-2022, separated by year.

4. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2017-2022, separated by year.

8. the total number of people who the sheriff’s department used force against, broken down by race/ethnicity, in 2022.

When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.

Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

8. 8.The total number of people who the sheriff’s department used force against, broken down by race/ethnicity, in 2022.

I would like to point out that your request includes a request for information on correctional/custodial operations. The Bullitt County Detention Center is under the direction of the Bullitt County Jailer, not the Bullitt County Sheriff. As a result, our office is not the custodian of records for their operation.
Additionally, we are a small agency with limited personnel. The information you are seeking is not readily available in our reporting system. It will require the retrieval and examination of a number of different documents and reports to determine what, if any, of the information is relevant to your request. In accordance with KRS 61.872 (6) this will place an unreasonable burden on our agency and our ability to provide service to our community. We do not believe we can fulfill your request as submitted. However, if you are can narrow your request so that it will be less time intensive, we will be happy to discuss it further. If you have questions, feel free to reach out to me at 502-543-2514 or don.cundiff@bcky.org<mailto:don.cundiff@bcky.org>. Thank you.

Hi, so in order to make this request manageable, let's narrow it down to the following item:

1. The total number of use of force incidents from 2017-2022, separated by year. Please include as part of this a breakdown of how many use of force incidents in 2022 were related to law enforcement operations and how many were related to correctional/custodial operations.

Thank you!

This email is in response to the follow-up to your previous request. We appreciate your understanding of the time constraints involved in a small office with limited personnel. Based on the reports that were located, the numbers below list the use of force incidents for the period 2017 - 2022. Please note that the current sheriff came into office in 2019. I was able to locate some reports for the year 2017, but none for 2018.

2017 - 5
2018 - 0
2019 - 13
2020 - 12
2021 - 13
2022 - 2

As I mentioned in my previous response, the Bullitt County Jailer, not the Bullitt County Sheriff, is responsible for the Bullitt County Detention Center. To obtain records on correctional/custodial operations you would need to contact that office. Thank you.
