We previously provided you with copies of a portion of the records which appear to be responsive to your request and advised you that we were still in the process of reviewing other potentially responsive records.

 

We have now completed our review of potentially responsive records. Attached please find an additional portion of records that appear to be responsive to your Public Records Act request.

 

With regard to the attached documents, please note a portion of these documents is exempt from disclosure under the following Government Code section(s): Deliberative Process -Government Code Section 6255; Preliminary Draft - Government Code Section 6254(a); Taxpayer Information - Government Code Section 6254(i); Trade Secret Privilege - Government Code Section 6254(k) Evidence Code Section 1060. I am responsible for this determination concerning your records request in my capacity as Records Management Technician, in consultation with Assistant City Attorney Suzanne Rawlings.

 

With regard to your request of “all emails and documentation regarding the vendor NextRequest”, a preliminary search of email records reveals in excess of 60,000 emails which may be potentially responsive to your request. Under the California Public Records Act (Government Code Section 6250, et seq.), persons who seek public records must present a reasonably focused and specific request so that the public agency will have an opportunity to promptly identify and locate such records and determine whether any exemption to disclosure applies (Fredericks v. Superior Court (2015) 233 Cal.App.4th 209, 217.). As stated in our earlier response to you, we would be happy to assist you in making a focused and effective request for the emails you may be seeking so that we may provide copies of the non-exempt potentially responsive emails to you and/or arrange for you to review them.
