(#R16) The "February 8, 2008 letter to the Division" per page 11 of REPORT OF INSPECTION, APPLICATION 18733.
(#R17) The "Division letter dated 9/19/2001" per page 11 of REPORT OF INSPECTION, APPLICATION 18733.
(#R18) A copy of the USBR report per the following text quoted from page 11 of REPORT OF INSPECTION, APPLICATION 18733: "2. The USBR shall submit to the SWRCB within six months of final SWRCB action in this proceeding a report that details how the USBR is calculating the releases required to satisfy the Harmans' and Menefee River Ranch's rights."
(#R19) The "2007 crop report" mentioned on page 5 of REPORT OF INSPECTION, APPLICATION 18733.
(#R20) The Fresno River Allocation Model (i.e., FRAM). The FRAM is a computer spreadsheet model developed by the USBR in cooperation with the State Water Resources Control Board and others. In fulfilling this request please provide a functional spreadsheet in a format such a Microsoft Excel file or other functional spreadsheet file.

When fulfilling my request I ask that you please number each request separately ("#R14," "#R15" and so on) so that the records do not all run together in a confusing manner. If electronic fulfillment by email is not possible I ask that the records please be mailed via Fed Ex mail with tracking information provided and an additional copy be made available for pickup in-person by private courier.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

This is a follow up response to your Public Records Act request. In regards to the following portion of your request:

"(#R18) A copy of the USBR report per the following text quoted from page 11 of REPORT OF INSPECTION, APPLICATION 18733: "2. The USBR shall submit to the SWRCB within six months of final SWRCB action in this proceeding a report that details how the USBR is calculating the releases required to satisfy the Harmans' and Menefee River Ranch's rights.""

Division staff familiar with this project have informed me that an item previously disclosed to you ("(#R20) The Fresno River Allocation Model (i.e., FRAM).") is the responsive document associated with #R18 above. On page 11 of the "Report of Inspection (#R15)", the following paragraph states:

"On August 6, 2001 , the Permittee satisfied Item No. 2 of the Order by submitting to the Division a spreadsheet entitled Fresno River Model 99-001-R-1-A. The Division found the model to be satisfactory and expected that it would assist the Permittee in assuring that proper releases are made as required in Item 1 (Division letter dated 9/19/2001)."

Please correct me if I am mistaken, but it appears that #R19 has not yet been fulfilled: "(#R19) The '2007 crop report' mentioned on page 5 of REPORT OF INSPECTION, APPLICATION 18733." Would you please provide an estimate as to when I can expect to receive documents responsive to #R19?

Hi Matthew,

Thank you for the responsive files. In reviewing R14 (1980 Kienlen report) it appears page 22 of the report is missing from the PDF you transmitted to me. If possible, would you please send page 22? This is just a guess, but if page 22 was a large fold-out map (not easily scanned?) I am thinking there is a chance the map was placed in an adjoining folder or file, or that the large map simply did not make it into the scanned PDF at the time of scanning. Again, this is just a guess.

Hi Matthew,

Upon further review of the 1980 Kienlen report, it appears that the missing page may contain text (not a map). The order of the missing page and the surrounding pages is as follows:

-Page 21 contains paragraph (1) as well as paragraphs (a) through (e).
-Page 22 is the missing page and may contain paragraph (2) and paragraphs (a) and (b).
-Page 23 is a map.
-Page 24 contains paragraphs (c) through (e).

Based on the nonsequential jump from "(e)" on Page 21 to "(c)" on Page 24 it appears that the missing page (Page 22) may contain paragraph (2) as well as paragraphs (a) and (b). In their search, Division staff may want to keep an eye out for a page of text-- not necessarily a map as I had previously speculated.

After reviewing several copies and what I believe to be the original report itself, I was unable to identify a page 22 in any of these versions. It is possible that this may have been a typographical error made by the publisher, but unfortunately I could not identify any copy of the report where page 22 exists.
