Pursuant to the Maryland Public Information Act, I hereby request the following records for every sworn officer and civilian member of the Calvert County Sheriff's Department, Prince Frederick for fiscal year 2023 and fiscal year 2024:

1. First and last name;
2. Unique sequence number;
3. Race;
4. Gender;
5. Hire date;
6. 2023 salary;
7. 2023 overtime;
8. 2024 salary;
9. 2024 overtime.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. Alternatively, please consider waiving any fees, pursuant to § 4-206(e)(2)(ii) of the General Provisions Article, as this request is on behalf of individuals served by the Maryland Office of the Public Defender, a state government agency, which solely serves indigent citizens of Maryland. As a result, my request for the above-listed public records is in the public interest. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good afternoon,

I have attached the two reports as filtered down in our new county software (Workday). Some of the information requested is not available in a report. However, I have attached as much as is possible at this time. Additionally, please find our response to your Public Information Request. Identifying factors (Names) have been redacted in accordance with §4-501 of the General Provisions Article of the Annotated Code of Maryland. The list requested by you, albeit a public record, is also a "personal record" pursuant to Section 4-501 of the General Provisions Article of the Annotated Code of Maryland because it names the employee. While the PIA makes it clear that the salary of a public employee is subject to disclosure, Section 4-401 of the General Provisions Article makes it unlawful for an employee of a governmental unit to willfully and knowingly allow inspection or use of a public record that names or, with reasonable certainty, otherwise identifies the individual by an identifying factor. Amongst other things, Section 4-501(c)(3)(iv) & (v) of the General Provisions Article states that the Custodian must disclose to persons of interest/employees: 1) whether the personal information is generally available for public inspection and 2) whether the personal information collected is made available, transferred or shared with any other entity other than the Custodian.

It could also be argued that this is a part of the employee's personnel record. [But for the exemption of the salary of a public employee], Section 4-311 prohibits inspection of an employee's personnel record except by the employee, an elected or appointed official who supervises the employee's work or an employee organization described in Title 6 of the Education Article of the Annotated Code of Maryland, none of which are applicable in this case.

It is our practice to disclose job titles and salaries only per the above listed provisions of the Annotated Code of Maryland.
