Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:

Charleston, West Virginia's application to the Commission on Presidential Debates to host one of 2016's four general election debates.

Requested records include all documents or files, digital or otherwise, attached to or enclosed with the application.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This email is in response to your request under the Freedom of Information Act dated July 28, 2015, seeking a copy of Charleston West Virginia's application to the Commission on Presidential Debates for hosting one of four 2016 general election debates (the "Request") and is supplemental to our original response of July 28, 2015, wherein we indicated additional time would be needed to review the Request and to discuss it with state or other governmental agencies.

Please be advised that the records you are seeking are exempt from disclosure under W. Va. Code § 29B-1-4(a)(1), (5) and W. Va. Code § 6-9A-4(b)(9), which exempt from disclosure records containing information or affecting matters involving commercial competition "which if made public, might adversely affect the financial or other interest of the state or any political subdivision". This exemption is applicable until a decision with respect to the locations of the debates has been rendered by the Commission on Presidential Debates.

Further, even after a decision has been rendered by the Commission on Presidential Debates, certain portions of the requested records will likely remain exempt from disclosure under W. Va. Code § 29B-1-4(a)(4), (9), (10), (11) and (14) because the requested records contain confidential plans, designs or maps related to security and public safety.
