Hello. I am writing to formally object to the extended delay in responding to my Public Records Act request, which sought emails from a single, specific email inbox. Your recent notification, citing Government Code § 7922.535 and asserting that the request requires the examination of "separate and distinct records," appears both factually incorrect and legally questionable.
This request is straightforward and does not involve separate and distinct records, as it pertains exclusively to the contents of a single email inbox. The technical process to search, collect, and review these emails is routine, and the records are likely easily accessible via standard search tools used by IT departments.
Moreover, while the Government Code permits time extensions in certain circumstances, indefinite delays without a clear and reasonable timeline for compliance violate both the spirit and letter of the California Public Records Act (CPRA). The Act requires public agencies to promptly make records available, subject only to narrowly construed exemptions. A year-long delay is excessive and inappropriate.
Please be advised that continued non-compliance could expose the City to potential legal action under the CPRA.
