Colorado -- Clinton and Hickenlooper speeches

To Whom It May Concern:

On April 7, 2016, Colorado Gov. John Hickenlooper held a Denver fundraiser for Hillary for America with former Secretary of State Hillary Clinton. News media at the time reported that the public was barred from this event, and that despite local noise ordinances, the Clinton campaign blasted loud static noise to prevent the public -- including the press corps -- from hearing the contents of speeches made outdoors. Pursuant to the Colorado Open Records Act, I hereby request the following records:

- Any transcript, notes or recording of a speech given by Gov. John Hickenlooper on 4/7/16 at Gov. Hickenlooper's Denver fundraiser for Hillary for America.

- Any transcript, notes or recording of a speech given by Hillary Clinton at Gov. Hickenlooper's 4/7/16 Denver fundraiser for Hillary for America.

As the Colorado Press Association notes, Colorado's sunshine laws apply to all public officials, and "all meetings of two or more members at which public business is to be discussed...are open." The fundraising event likely included more than two Colorado public officials, meaning it should be subject to open meeting laws, and the Colorado Open Records Act. You can find more about those open meetings laws here: http://www.coloradopressassociation.com/img/site_specific/uploads/sunshineLaws.pdf

Please search for responsive records regardless of format. I request the information in a machine-processable format, such as a spreadsheet (CSV or XLS) or word processor (TXT, DOC, DOCX) format. It can be provided by email, thumb drive, or CD. If it is unavailable in any other format, an OCRed PDF (i.e. searchable) will do.

If it is your position that some of these records are available but others are not (or a part of the request is too broad), please provide me with the records that are available.

If it is your position that any portion of the requested records is exempt from disclosure, I request that you provide it with an index of those documents. In the event some portions of the requested records are properly exempt from disclosure, please disclose any reasonably segregable non-exempt portions of the requested records. If it is your position that a document contains non-exempt segments, but that those non-exempt segments are so dispersed throughout the document as to make segregation impossible, please state what portion of the document is non-exempt, and how the material is dispersed throughout the document.

I request a waiver of fees associated with processing this request for records. International Business Times is a news media organization. Disclosure of the requested information to me is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

David Sirota
