Pursuant to the Colorado Open Records Act (CORA), I am requesting access to and a copy of the logs of all CORA requests submitted to your agency over the past 180 days. This request includes, but is not limited to, the dates of requests, the nature of the requests, the responses provided, and any associated correspondence.
Please provide the requested records in an electronic format if possible. If there are any fees for searching, reviewing, or copying the records, please inform me before processing my request. Additionally, if you need any further information or clarification to locate these records, please let me know at your earliest convenience.

As provided in our rules related to CORA and allowed under section 24-72-205(6), C.R.S., we charge a fee of $30 per hour after the first hour of staff time required to search for, retrieve, and review the responsive documents (8 C.C.R. 1505-12-4.3). We have exceeded the initial one hour of time. In accordance with our rules, we will require you to pay a deposit equal to the estimated fees before beginning our review of the documents (8 C.C.R. 1505-12-4.4). If it appears that we will require additional time beyond the estimate, we will advise you of the additional time and request approval of the additional charges before proceeding. If the request takes less time than estimated, we will refund the unearned portions of the deposit.
We estimate that completing your request will take 35 hours of time and therefore we require a deposit of $1,050.00 to proceed. Payment may be made by check, made out to the Colorado Secretary of State, and delivered to "ATTN: FINANCE, CORA PAYMENT" at the address in the signature block below. Please remit payment by 16 August, 2024. If we do not receive payment, we will consider your request closed.
Alternatively, you may choose to narrow the scope of your request to reduce or eliminate this fee. On Friday, July 26th, our office received multiple emails from you regarding your CORA request (for ease of reference, I've attached those emails). The below responses answer your various questions.

* Fulfilling your request would require staff time for both collection and review for legal withholding as required by law. Staff time would be spent primarily on collection and review of responsive correspondence.

* While an initial collection was performed, our office is required by law to review all records it releases under CORA.

Thank you for your response. I would like to clarify that under the Colorado Open Records Act (CORA), there is no statutory requirement for formalities in submitting a request. As such, my original request remains valid and should not have been closed without legal justification.
Additionally, please provide a detailed breakdown of any anticipated costs as required. I also remind you that under CORA, records related to requests must be maintained for at least two years. I kindly ask for the specific statute or legal basis you are relying on to justify the closure of my request, as this action does not appear to be supported by the CORA Act.
Please consider this communication as a continuation of my initial request, and I expect your office to proceed with it in accordance with the law.

Completing your request will take 6.1 hours of additional staff time to search for, retrieve, and review the responsive records. That is based on an initial search determining there will be at least 182 pages of records to review. Our office charges a fee of $30 per hour after the first hour of staff time spent. This adds up to a fee estimate of $182.00.
Our office retains all CORA requests for two years; however, we administratively close those requests where deposits are not paid.
