RE: PUBLIC RECORDS REQUEST
Reference # C001462-020525.
Dear Cory Dawson, We have prepared a cost estimate for the Public Records requested by you on 2/5/2025 9:54:40 PM pertaining to the above referenced open records request number. We have determined that complying with your request for public information will result in the imposition of a charge that exceeds $40.  Therefore, the following statement is provided pursuant to TGC, Chapter 552, § 552.2615. Your request will be considered automatically withdrawn if you do not notify us in writing and within 10 (ten) business days from the date of this statement that you:
* Accept the charges and agree to pay;
* Modify your request (if you choose to inspect records, it is considered a modification); or
* Have sent to the Cost Rules Administrator at the Office of the Attorney General (OAG) a complaint alleging that you have been overcharged for being provided with a copy of the public information. We anticipate that the copies will be completed within a reasonable amount of time after we receive notice that you accept the charges and we receive your payment. There are less expensive ways of obtaining this information. These charges may be reduced if you choose to modify your request by either narrowing or clarifying the scope of your request. You may also come and inspect the records in person. Some of the requested documents may contain mandatory confidential information and public information. The charge to inspect the documents with the mandatory confidential information redacted is provided on your invoice. If you do not want to inspect the documents that may contain mandatory confidential information and public information, you may inspect the documents free of charge. In general, if you choose to inspect the information, you will be able to take notes without charge.  If you choose to receive copies, the cost of copies is @ $.10/page, and if more than 50 pages, the personnel and overhead charges will be allocated to the number of pages you take. You may choose to respond by using the online portal, email, regular mail, or by dropping your written response in person at our offices: By email: openrecords@dallascityhall.com By mail/in person: City Secretary's Office, ATTN: Open Records Center, 1500 Marilla Street, 5DS, Dallas, Texas 75201 Please note that no work will be undertaken until we receive your written response. If your request is also in excess of $100, in accordance with § 552.263, we request a deposit of 50% of the total balance due.  If you accept the charges, and a deposit has been requested, your request will be considered received on the date we receive the deposit.  If the deposit is not paid within ten (10) days, the request will be considered to have been withdrawn by you. If you accept the charges, and payment has been requested, your payment must be received before any copies will be released. If you pay a deposit and the actual final amount is less than the amount paid, you will be issued a refund by separate cover.  If the actual amount is more than what you paid but within 20% of that amount, payment must be made in full before you can receive the copies.  An updated statement will be sent to you if the final amount will exceed 20% of the first agreed estimated amount. Please make your payment via our online portal or in person. If you choose to pay by check or money order, it must be made payable to the City of Dallas, and mailed to: City Secretary’s Office, ATTN: Open Records Center, 1500 Marilla Street, 5DS, Dallas, Texas 75201.  You may also pay by check or money order at our offices.
Respectfully,

Dear Nancy Gonzalez,

Thank you for your time and attention to this matter. I'd like to clarify what the city has compiled before moving forward with payment. The invoice attached states in part "the city of Dallas has compiled records responsive to your request." The email above however states "We have determined that complying with your request for public information will result in the imposition of a charge that exceeds $40."

For my understanding, is it the case that the city has at this point determined there are records (approximately 600 emails according to the invoice) that are responsive to the request, and payment will go toward necessary due diligence (legal review, exhaustive searches, etc.) required to release said records as the invoice statement appears to suggest?

Or is it the case that the cost estimate is not at this point indicative of if there are responsive records, rather the payment is what is required to ascertain if there are responsive records and further to complete due diligence needed to release the records, as the body of the email seems to suggest?

Thank you again for your help.

Best,
Cory Dawson

Dear Cory Dawson: The City of Dallas is in receipt of your correspondence. While City staff is working to respond to your request, the department(s) that maintain the requested information are unable to produce it for inspection or duplication within ten (10) business days of the City’s receipt of your request because either a voluminous amount of information is requested or an extensive search is necessary to identity responsive information. Pursuant to Section 552.221(d) of the Act, therefore, the City certifies that the requested information will be available for production or inspection no later than 5:00 pm on APRIL 11, 2025.
