The response to your FOIA request for information related to 625 ILCS 5/2-130 is included below. Let me know if you have any questions.
Our policy, which is attached, is currently being reviewed to see if any changes need to be made to ensure compliance with this new statute.
Our Training Materials would include our LPR policy, which is attached. We also have a policy that addresses the status of IL as a Sanctuary State. The "Trust Act and VOICES Act" policy includes a section that prohibits law enforcement from enforcing federal civil immigration laws. The policy also prohibits us from stopping, detaining or arresting anyone based solely on their immigration statuts or immigration detainer.
LEAs must affirm that they will never use IL LPR data to investigate or enforce a law that would interfere with a person obtaining reproductive or other health services or that relate to a person's immigration status. If they fail to affirm this, they will not be granted access to IL networks.
An audit has not been completed to assess adherence to this specific statute; however, there are no cameras in place that would in any way violate 625 ILCS 5/2-130(b)(1). Officers are also aware of our policy regarding subsection (b)(2) as it's covered in the Trust Act and IL Voices Act policy. We've not been alerted to any possible violations that would require an internal investigation.
We have no records or reports of any allegations of abuse or misuse of the LPR cameras.
