Regarding your numerous requests for the 911 call and texts for the Megan Stanley Domestic Violence case, the files you have requested are considered investigative records and are exempt from disclosure under the Public Records Act as law enforcement investigation records. Gov. Code, §§ 7923.600-7923.625 (formerly Gov. Code, § 6254(f)); (“Records of . . . investigations conducted by . . . a local police agency, or any investigatory files compiled by any other state or local agency for . . . law enforcement purposes.”); Haynie v. Superior Court, 26 Cal. 4th 1061, 1071 (2001) (holding that citizen reports and police radio calls related to traffic stops were exempt from disclosure under Section 6254(f)). Investigative files reflecting the analysis or conclusions of the investigating officer are expressly exempt from disclosure per Gov. Code § 7923.605(b).

Furthermore, these investigative records continue to be exempt from disclosure even after the investigation has concluded. Rackauckas v. Superior Court, 104 Cal. App. 4th 169, 174 (2002) (“The investigation exemption does not terminate when the investigation terminates.”) (citing Williams v. Superior Court, 5 Cal. 4th 337, 354-55 (1993)).

The Davis Police Department will not be releasing the 911 call or texts for this case. Because the Department will not provide the exempt information described above, the Public Records Act requires that notification of denial of any request for records must include the names and titles or positions of each person responsible for the denial. See Gov. Code § 7924.105 (formerly Gov. Code § 6253(d)). The person responsible for the decision is Davis Police Chief Todd Henry.
