To Whom It May Concern: Pursuant to the Delaware Freedom of
Information Act (29 Del. C. ch. 100), I hereby request the following
records: Please provide one copy of the FDA Form-2579 report of
assembly, or equivalent, for the computed tomography x-ray (CT) system
that was installed at Christiana Hospital in Newark, Delaware on
December 17, 2020 (see attached FDA X-Ray Assembler Database Search
Results, also available at
https://www.accessdata.fda.gov/scripts/cdrh/cfdocs/cfassem/assembler.cfm?ID=615018).
This request is not being made for commercial purposes. In the event
that any associated fees exceed $25.00, I would be grateful if you
would advise me of the total charges before fulfilling my request. My
preference is that the request be fulfilled electronically, by e-mail
attachment in PDF format, if available, or CD-ROM, if not. Thank you
in advance for your cooperation in this matter. I look forward to
receiving your response to this request within fifteen (15) business

NOTICE: Under Delaware’s Freedom of Information Act, 29 Del. C.
§§ 10001-10007 (“FOIA”), a FOIA request or petition, along with
any information contained therein or any documents attached thereto,
submitted to any “public body” subject to FOIA, including, without
limitation, any board, bureau, commission, department, agency or
committee of the State, may itself be deemed a “public record”
subject to disclosure under FOIA.

This is in response to your request dated9/4/2024 to the Department of Health & Social Services (DHSS) under the Delaware Freedom of Information Act, 29 Del. C. §§10001-10007 (FOIA).

FOIA provides for access to public records for citizens of the state of Delaware. Accordingly, because you are not a Delaware citizen, your request is not subject to Delaware FOIA law. See Del. Op. Att. Gen. 16-IB20 (2016) (finding that the denial of a FOIA request by a non-Delaware citizens was not a violation of FOIA because the word “‘citizen,’ as used in Section 10003(a), refers to citizens of the State of Delaware.”). Based on the foregoing, DHSS is denying your request.
