Pursuant to the Delaware Freedom of Information Act, I hereby request the following records:
A list of all requests or applications for qualified contracts for LIHTC developments submitted to the Delaware State Housing Authority, including the following:
1) The year of the application or request
2) The projects's name, full address, and ownership
3) The qualified contract price
4) The total number of units covered
5) The outcome of the request and start and end dates of the deregulation period, if one ensued
6) Any information retained by the agency on the requester or applicant, including their name, contact information, and organizational affiliation
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Thank you for your July 31, 2024, Freedom of Information Act (FOIA) request for information about LIHTC applications submitted to the Delaware State Housing Authority. I apologize for the delayed response. Your letter was temporarily held up and only just reached the FOIA team.
FOIA provides citizens of the state of Delaware access to public records. Accordingly, since your mailing address is out of state, you do not have a guaranteed right under FOIA to access the State of Delaware public records. See Del Op Att'y Gen. 16-IB20 (2016) (finding that the denial of a FOIA request by a non-Delaware citizen was not a violation of FOIA because the word "'citizen,' as used in Section 10003(a), refers to citizens of the State of Delaware."). Delaware State Housing Authority is denying your request because the right to access documents pursuant to FOIA is not guaranteed for non-Delaware citizens.
