The Deschutes County Sheriff's Office acknowledges your public records request
and we are working diligently to review your request.  Our obligation is to
fulfill your request as soon as practical and without unreasonable delay.  Our
response time will depend upon the amount of material requested, whehter or not
we are the custodian of the requested records, how much material in the records
is exempt from disclosure, and the difficulty of determining whether specific
information is exempt and how long it takes to redact exempt information.
If we are the custodian of records, our next step will be to estimate the
reasonable cost of producing the records.  The estimated fees must be paid
prior to the release of the records.  In the event that the actual costs of
producing the records exceeds the estimated costs, you must pay the additional
fee before the records are released.  In the event the actual cost of producing
the records is less than the estimated costs, you will be issued a refund of the
difference.   The estimated costs must be paid even if it later turns out that
all or part of the responsive records are exempt from disclosure.  We will do
our best to let you know if we believe some or all of the records will be exempt
from disclosure before you determine whether to pay the estimated fee.  Once we
have provided you with the estimated costs of producing the records, you will
have 60 days to pay the estimated cost.  If we have not received payment within
60 days we will close the request.
We do our best to fulfill all requests within twenty business days of the date
the estimated costs are paid.  In some cases, requests may take significantly
longer.
If you are requesting a waiver or reduction of fees, you will need to provide
detailed information demonstrating how the release of the records primarily
benefits the general public, as opposed to benefitting a specific person or
entity. Also, please explain your ability to disseminate the records broadly to
the public.
If you believe our estimated fees are too high, we are happy to discuss ways to
narrow your request to reduce the costs.  If you are not satisfied with that or
if you feel that our decision not to provide certain exempt records is wrong,
you may file a challenge in the Deschutes County Circuit Court pursuant to ORS
192.427.

Zeek,
DCSO is in receipt of your public records request for email correspondence between May 31, 2017, and September 16, 2024. Due to the high volume of public records requests DCSO has been receiving, we apologize for the delay in responding to your request (ORS 192.329(6)).

The fee estimate for the requested search/records is as follows which includes a fee reduction per your request showing the dissemination to the public and not for commercial purposes:

* Review for relevant email boxes to search, search of email boxes containing requested term/s and review email results for exemptions/redactions: 2.5 hours at Actual Cost of Service for paralegal services ($76.13/hour) = $190.32. Legal Counsel review of records ¼ hour at $150/hour = $37.50
fee estimate: $227.82
25% reduction: - 56.95
TOTAL: $170.87

The estimated fees must be paid prior to the release of the records. In the event that the actual costs of producing the records exceeds the estimated costs, you must pay the additional fee before the records are released. In the event the actual cost of producing the records is less than the estimated costs, you will be issued a refund of the difference. The estimated costs must be paid even if it later turns out that all or part of the responsive records are exempt from disclosure. You have 60 days to pay the estimated cost. If we have not received payment within 60 days, we will close the request.

We do our best to fulfill all requests within twenty business days of the date the estimated costs are paid. However, due to staffing and the high volume of public records requests we are currently receiving it could be significantly longer.

Thank you.
Crystal
