Pursuant to the Oregon Public Records Law, I hereby request the following records:

Materials related to and sufficient to show all instances of alleged or actual inappropriate or illegal behavior or actions resulting in compensation or expenditures involving this agency.

Responsive materials include records of all settlements (formal and informal) and payments to which this agency was or is a party for the period from January 1, 2010 through the date this request is processed. Responsive materials include those for matters and legal claims resolved prior to the initiation of any litigation.

In particular, materials responsive to this request include all reports, lists, databases, spreadsheets, and other documentation detailing incidents of legal claims or other allegations requiring compensation for claimants, attorneys, or any other party.

If spreadsheets or similar documents are available in response to this request, please provide all segregable data, including but not limited to:

The nature of the claim or legal matter
The claimant and other parties involved
The relevant case and tracking numbers for court and internal systems
The date the lawsuit was served or litigation commenced
The final disposition or current status of the case, including whether a case is still pending
The amount spent to date as a result of the legal engagement
The amount paid to any parties related to the legal claim, including any city payout and any non-monetary compensation

Hello,

The City is the custodian of records responsive to your request. Specifically, the City has settlement documents concerning three motor vehicle accidents and damage to a fence. We have no responsive documents for use of force claims.

We estimate it would take 2 hours to collect the records and separate exempt from non-exempt material. The exemptions are for personal privacy (ORS 192.355(2)) and internal affairs documentation (ORS 181.854(3) or 192.345(12)). The City’s fee schedule establishes an hourly rate of $39.43 per hour for staff research time. https://www.eugene-or.gov/DocumentView.aspx?DID=476. Thus, the estimate to respond to your request is $78.86.

If you would like to proceed with all or a portion of your records request, you will need to provide me with written authorization to proceed and pay the estimated costs for that request. There is no charge for copies provided the records are delivered electronically. Otherwise, our fee schedule sets out the copying costs.

Upon payment, the City will search for the record(s) and will provide copies of the records for which the City does not claim an exemption from disclosure as soon as practicable. If the actual cost of this records request exceeds the estimated amount, the requestor is required to pay the difference prior to records being released. If the estimated cost of the records request exceeds the actual cost, the City will refund the difference.

For any record that the City asserts an exemption you may seek review of the City’s determination as indicated in ORS 192.329(2)(f).
