To Whom It May Concern:

Pursuant to the Arkansas Freedom of Information Act § 25-19-101 et seq., I am requesting an opportunity to obtain copies of public records that indicate the testing dates on which students in grades 3-10 (inclusive) were scheduled to take the ACT Aspire summative assessments during the 2015-16, 2016-17, and 2017-18 school years. Specifically, I am looking for the "Detailed ACT Aspire Summative Schedule" for the 2015-16, 2016-17, and 2017-18 school years, which includes the dates on which students in each grade took a specific subject test (i.e., math, reading, ELA, STEM, science, writing). The information contained in these testing schedules would be equivalent to the information contained in the 2018-19 calendar posted at the following website: https://district.fayar.net/o/fps/page/testing-dates--2.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $10. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of student achievement and safety drills. This information is not being sought for commercial purposes, only for academic purposes. The requested documents will be made available to the general public.

The Arkansas Freedom of Information Act requires a response within three business days. If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Elc Estrera
