In 2016, the SBA was directed to create a "scrutinized companies" list composed of companies that participate in a boycott of Israel, including actions that limit commercial relations with Israel or Israeli controlled territories. This list is supposed to be updated quarterly.

Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the latest version of this list.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

This is a follow-up to a Sunshine Request initially submitted by email on February 9, 2018 to Dennis MacKee <Dennis.MacKee@sbafla.com>.

As you are undoubtedly aware, statute requires you to acknowledge such requests "to inspect or copy records promptly and to respond to such requests in good faith" (Section 119.07(1)(c))

While the statute does not define the term "promptly," I believe we can all agree that a ten month wait is not prompt.

I ask that you respond to this request in good faith so that we need not initiate civil actions.

To be fair -- I initially requested these docs in Feb 2018, and faxed them to your office last December, so presumably Dennis was still working there at the time.

Regardless -- thank you for these docs, I don't recall them being on the website when I last looked 18 months ago.

Dennis retired August 1, 2017.

The report has been posted since its creation in statute. Florida Statute at the time stated:

(2) IDENTIFICATION OF COMPANIES.—
(a) By August 1, 2016, the public fund shall make its best efforts to identify all scrutinized companies in which the public fund has direct or indirect holdings or could possibly have such holdings in the future. Such efforts include:
1. To the extent that the public fund finds it appropriate, reviewing and relying on publicly available information regarding companies that boycott Israel, including information provided by nonprofit organizations, research firms, international organizations, and government entities;
2. Contacting asset managers contracted by the public fund for information regarding companies that boycott Israel; or
3. Contacting other institutional investors that prohibit such investments or that have engaged with companies that boycott Israel.
(b) By the first meeting of the public fund following the identification of scrutinized companies in accordance with paragraph (a), the public fund shall compile and make available the “Scrutinized Companies that Boycott Israel List.”
(c) The public fund shall update and make publicly available quarterly the Scrutinized Companies that Boycott Israel List based on evolving information from, among other sources, those listed in paragraph (a).

While annual legislative statutory revision has cleaned up unneeded language, the SBA was required to post the report beginning in August 2016. From that point on, we have posted quarterly updates contained in the Global Governance Mandates report I linked in my previous email. Once the Trustees approve a new report, it is posted in place of the old report.

I would appreciate if you could share when and which fax number you sent your request to so I can determine the issue we are having.

I hope this additional information is helpful, and I appreciate your assistance in trying to determine the issue with the fax machine.
