The Public Records Act (PRA) does not support mere requests for "information". The PRA is for "records" maintained and existing within the agency. The PRA also generally does not support demands for the "creation" of custom records by an agency and an agency is not required to "create" records that do not already exist in a format kept and maintained by the agency. The Fresno County Sheriff's Office has the "information" you are requesting but we do not track and/or maintain records in the above listed format.

In order for us to produce this information for you, it will require our IT Department to extract the data out of the various systems we have that contain it. Per Government Code section 6253.9(b)(2), we are allowed to charge the "direct costs" related to programming, extracting and compiling this information for you.

Under the current (2020-21) Fresno County Master Schedule of Fees, the current rate for our IT Unit to complete your request is $79.00 per hour.

(See https://www.co.fresno.ca.us/home/showpublisheddocument?id=47169. Look for Sheriff's Office (MSF2600) and find it under IT Labor Rate.)

I don't know how long it would take them to complete your request.

Please advise if you are agree to pay the above rate related to the cost to gather this information for you. If so, I will then send this request to get an estimate so you can plan accordingly.

I look forward to hearing from you,
Frances

Hello Lieutenant Devins,

Please proceed with the request and let me know what the estimate ends up being. In order to process a payment, my organization requires a W9 form for documentation. Could you please complete and return the attached form? And if you could please let me know the details of whom/where to send the payment, that would be helpful as well.

Thank you and much obliged,
Colin Gerber

From: Fresno County Sheriff's Office

Hello Colin,

I have sent your request to my IT Unit to get an estimate for the cost. As soon as I get that, I will have an invoice drafted and send that to you.

I should know how long it will take so you can be billed by next week.

Thank you,

Frances

From: Fresno County Sheriff's Office

Hello Colin,

I received a response back from my IT Unit on the time it will take to write the program to extract the data you are requesting and they estimated it will take approximately 8 hours. I had an invoice created, which is attached, with that estimate and the cost.

Once it is paid, I can have the IT Unit begin the work to get you the information you are requesting.

If you decide to do something different or don't want the information after all, please let me know so I can close the request out.

Thank you,
Frances

Thank you Lieutenant Devins,

In order to submit the order for payment, my organization requires a completed W9 for the Fresno County Sheriff's Office. Is that something you are able to provide? With that in hand, I can submit the payment order and get it processed.

Much obliged,

Colin Gerber
