Pursuant to the { Georgia Freedom of Information Act }, I hereby request the following records:

- A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company.
- If the contract(s) was cancelled, any and all materials related to its cancellation.
- If the contract was cancelled, the statement from the university about cancellation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your January 23, 2023, request for documents under the Georgia Open Records Act, and is in accordance with the three-day period of response pursuant to O.C.G.A. § 50-18-71(b)(2).

You have requested "a copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise."

With respect to your request, we have reached out to units/departments across campus where responsive records may exist so that we can prepare search, retrieval, review, and production time/cost estimates. We anticipate having an update for you by February 16, 2023, if not sooner.

This is a follow-up response to your Open Records Act request.

To reiterate, you have request:

- A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company.

- If the contract(s) was cancelled, any and all materials related to its cancellation.

- If the contract was cancelled, the statement from the university about cancellation.

With respect to your request, the Georgia Open Records Act allows charges for search, retrieval, review, redaction, and production in connection with compliance; provided, however, that no charge is made for the first quarter-hour. Our search, retrieval, review, redaction, and production charges in complying with this request will be two (2) hours for a total estimate of $66.50 and will require 10 business days for production. The Act also allows for an agency to defer search and retrieval of records until the requester agrees to pay the estimated costs. We ask that you provide confirmation, in writing, to us that you agree to pay these estimated charges.

At this point, some information may be exempt from release in accordance with O.C.G.A. § 50-18-72(a)(1), (20)(A), (21) and (37). As we process your request, there may additional exemptions. We will notify you of any additional exemptions no later than three business days after the records have been retrieved in accordance with O.C.G.A. § 50-18-71(d).

This is a follow-up response to your March 3rd email inquiring about your Open Records Act request for “a copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization.”

First, your highlighted statement below is incorrect. We never said that your request would be completed by Feb. 16.

"Also, on Feb. 16, we provided time and cost estimates of two (2) hours for a total of $66.50 and 10 business days for production to search for, retrieve, and produce any responsive documents.

As we wrote Feb. 16, we are awaiting your written confirmation that you agree to pay these charges before proceeding.
