Pursuant to the Georgia Open Records Act, I hereby request the following records:

* Any risk assessments or incident response plans produced by the university between October 7, 2023 and the time that this request is processed that mention any of the following words: "protests," "demonstrations," "picketing," "occupation," "camp," "encampment," "Israel," "Gaza," or "Palestine."

* Any reports or logs about surveillance activities on pro-Palestine or pro-Israel student protesters produced by the university, university police, or local police . These may include written reports based on CCTV camera footage, reports of relevant social media posts, plans for future surveillance, etc.

* Any agreements (including informal, not-signed agreements that would take place over email) or memoranda between the university or university police and local police between October 7, 2023 and the time that this request is processed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your May 2, 2024, request for documents under the Georgia Open Records Act, and is in accordance with the three-day period of response pursuant to O.C.G.A. § 50-18-71(b)(2).

You have requested:

* Any risk assessments or incident response plans produced by the university between October 7, 2023, and the time that this request is processed that mention any of the following words: “protests,” “demonstrations,” “picketing,” “occupation,” “camp,” “encampment,” “Israel,” “Gaza,” or “Palestine.”

* Any reports or logs about surveillance activities on pro-Palestine or pro-Israel student protesters produced by the university, university police, or local police. These may include written reports based on CCTV camera footage, reports of relevant social media posts, plans for future surveillance, etc.

* Any agreements (including informal, not-signed agreements that would take place over email) or memoranda between the university or university police and local police between October 7, 2023, and the time that this request is processed.

As a preliminary matter, “the time that this request is processed,” is the arrival date of the request, which is May 2, 2024.

Also, the Georgia Open Records Act does not create an affirmative duty for an agency to create records where none may not currently exist. An agency is not required to prepare reports, summaries, or compilations not in existence at the time of the request. An Open Records Request is meant to provide access to documents. See O.C.G.A. § 50-18-70(b)(2); § 50-18-72(d); 1989 Op. Att’y Gen 89-32.

With respect to your request, we have reached out to where responsive records may exist so that we can prepare search, retrieval, review, and production time/cost estimates. We anticipate having an update for you by May 22, 2024, if not sooner.
