Records Request re: Fulton County Board of Registration and Elections

Subject: Public Records Request

Dear Custodian of Records,

Pursuant to the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.), I am requesting copies of any and all public records or documents related to voter roll challenges that have been filed or submitted to the Fulton County Board of Registration & Elections within the last 30 days. This request specifically includes, but is not limited to, the following types of records from the following individuals:

• Sherri Allen (Chairperson)
• Aaron V. Johnson (Vice Chairperson)
• Michael Heekin (Board Member)
• Teresa K. Crawford (Board Member)
• Julie Adams (Board Member)
• Nadine Williams (Director)

The records should include:

• Text messages
• Emails (including any emails with the keywords “voter rolls,” “voter roll challenges,” “voter roll challenge,” “ineligible voters,” and “challenge” in the subject line or body of the email, as well as any other emails related to voter roll challenges that may not use these specific terms)
• Faxes
• Memos
• Handwritten letters

Please note that I do not seek any personal information of voters, such as names, dates of birth, or addresses. I am solely interested in the communications between the board members regarding any voter roll challenges submitted in the last 30 days. Should any of the requested documents contain such personal information, I request that you redact it in accordance with O.C.G.A. § 50-18-72(a)(20)(A), which requires the redaction of confidential information to allow for the disclosure of public records.

Please provide the requested documents in electronic format. If there are any fees for searching or copying these records, please inform me of the total cost before fulfilling my request. However, I request a waiver of all fees as this request is in the public interest.

As required by O.C.G.A. § 50-18-71(b)(1)(A), I expect a response to this request within three business days. If any records cannot be provided within this timeframe, please notify me of the reasons and specify a reasonable timeline for when the records will be available.

If you deny any part of this request, please provide a detailed explanation of the grounds for the denial, including the specific exemption you believe justifies withholding the information.

Mr. Heekin, This public records request was submitted to you on 8/20/2024, and submitted to Elections.VoterRegistration@fultoncountyga.gov even earlier on 8/15/2024.
As required by O.C.G.A. § 50-18-71(b)(1)(A)
"In any instance where records are unavailable within three business days of receipt of the request, and responsive records exist, the agency SHALL, within such time period, provide the requester with a description of such records and a timeline for when the records will be available for inspection or copying and provide the responsive records or access thereto as soon as practicable."

To date nobody from the Fulton County Board of Registration and Elections has responded to the public records request or produced any of the records being sought.

Please let me know a timeframe for which I can expect to receive the records requested.
