Pursuant to the New York Freedom of Information Law, I hereby request the following records:

All communications (emails, text messages, etc.) between members of the Board of Education concerning the decisions to be made/that are made during the Executive Session at the Board of Education meeting on Friday, March 25, 2022, at 3:30 p.m. at the Phipps Administration Building.

The review of classroom materials and teaching by the district in an English 11 Regents class at Great Neck North High School, mentioned at the November 17, 2021 Board of Education meeting and in the livestream (https://www.youtube.com/watch?v=W6zJLsBe_fA) of such meeting at timestamp 13:34 by Superintendent Prendergast.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This letter will formally acknowledge receipt of your March 25, 2022
Freedom of Information Law (“FOIL”) request, received by this Office on
March 25, 2022.

Please be advised that the District will respond to your request by either
granting or denying the request, in whole or in part, within twenty (20)
business days from the date of this acknowledgment letter. However, if
circumstances prevent the disclosure of the materials sought within twenty
(20) business days from the date of this acknowledgement letter, the
District will contact you in writing to provide a reason for the inability
to grant the request within such time period and a reasonable date certain
of when the request will be granted, in whole or in part.

Please be further advised that the District charges the statutorily
permitted fee of $0.25 per page for duplication of records requested under
FOIL, unless the same are available for electronic transmission.

Can you please specify in what ways the two requests are vague? To clarify, at the Board of Education meeting provided in the initial request, it is stated "The district is actively reviewing these materials and will work collaboratively with our teachers and administrators to ensure that information is presented in a viewpoint neutral manner that stimulates critical thinking and reasoning skills." The second request pertains to the review of the materials that Dr. Prendergast was talking about.

New York Freedom of Information Law N.Y. Pub. Off. Law Ch. 47 Art. 6 § 87(b) specifically requires that an agency provide an acknowledgement to a public records request within 5 business days of receipt of that request and a response not longer than 20 days after.

By failing to respond to this request within the legally-mandated timeframe, this agency is in violation of the law.

Please provide acknowledgement of this request and the responsive materials forthwith. reviewing the documents requested. Due to the nature and scope of your

your FOIL request. Accordingly, the District intends to provide you with
copies of the documents, to the extent that the same are subject to
disclosure under the Freedom of Information Law, by May 31, 2022. Should
additional time be required to process your request, you will be contacted
before said date. Please further note that, in the event that any
responsive documents become available for disclosure, in whole or in part,
prior to the foregoing time period you will be immediately contacted.
