Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

Any and all contracts (including all associated amendments and exhibits), memorandums of understanding, and any other agreements, as well as all grant applications and approvals, regarding this agency's involvement in Massachusetts cannabis eradication programs during the year 2016, as well as all plans, procedures, and incident reports created as part of operations under such programs conducted from January 1, 2016 through the date this request is processed.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

On October 17th, 2016, we received your request pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10 for:

* Any and all contracts (including all associated amendments and exhibits), memorandums of understanding, and any other agreements, as well as all grant applications and approvals, regarding our agency's involvement in Massachusetts cannabis eradication programs during the year 2016, as well as all plans, procedures, and incident reports created as part of operations under such programs conducted from January 1, 2016 through the date this request is processed.

With respect to your request, please be advised that this Department has none of the requested records, as our department has no direct involvement with the program, nor has any report been generated relative to the program.

The mandatory disclosure provision of the Public Records Law only applies to information that is in the custody of the Department at the time the request is received. Since the Department does not have any such records, no records are being produced in response to this request.

Please be advised that pursuant to 950 CMR 32.00 and G.L. c. 66, section 10(b) you have the right to appeal this decision to the Supervisor of Public Records within 90 days. Such appeal shall be in writing, and shall include a copy of the letter by which the request was made and, if available, a copy of the letter by which the custodian responded. The Supervisor shall accept an appeal only from a person who had made his or her record request in writing.
