Pursuant to the Pennsylvania Right to Know Act, I hereby request the following records:
For purposes of this request, "SCANDALOUS OR DISGRACEFUL CONDUCT POLICY" means any of: (a) Executive Order No. 1980-18 Amended, dated May 6, 2024, 54 Pa.B. 3018; (b) 4 Pa. Code § 7.158.1 ("Personal conduct," providing that "No employee, appointee or official of the Executive Branch of the Commonwealth may engage in scandalous or disgraceful conduct, or any other behavior, on or off duty, which may bring the service of the Commonwealth into disrepute") or (c) any policy, guidance, regulation, or other prohibition against "scandalous or disgraceful conduct, or any other behavior, on or off duty, which may bring the service of the Commonwealth into disrepute."
1. Any records reflecting a complaint, charge, or disciplinary action concerning any violation (or alleged violation) of a SCANDALOUS OR DISGRACEFUL CONDUCT POLICY.
2. Any records reflecting any warning issued to any employee concerning the SCANDALOUS OR DISGRACEFUL CONDUCT POLICY.
3. Any policy, guidance, regulation, or handbook concerning the SCANDALOUS OR DISGRACEFUL CONDUCT POLICY.
This request is limited to records generated on or after May 5, 2024.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Steinbaugh:
This email acknowledges receipt by the Pennsylvania Treasury Department (“Department”) of your email request for records, received in this office on January 23, 2025, under the Pennsylvania Right-to-Know Law (“RTKL”) (65 P.S. §§ 67.101 et seq., as amended). A copy of your request is attached.
This request references an Executive Order known as the Governor’s Code of Conduct and regulation 4 Pa.Code § 7.158.1 regarding personal conduct. As a preliminary matter, please note that neither of these apply to the Department because the State Treasurer is an independently elected row officer and is not required to adopt the policies of the Governor’s Office, although the Department can choose to adopt them. At this time, the Department has not adopted the “Scandalous or Disgraceful Conduct Policy” referenced in the request.
This request seeks the following:

Right to Appeal
When a request is denied, whether in whole or in part, or deemed denied, you may file an appeal with the Department. This appeal must be in writing and must be filed with the Department within fifteen (15) business days of the date of the Department’s denial or deemed denial. The appeal must state the grounds upon which you assert that the record is public, and should address any grounds stated by the Department for denying the request or any grounds stated in the Department’s extension notice that contains an expected response date in excess of 30 days following the five days allowed for in Section 67.901 of the RTKL. The appeal shall be sent to:

The Department will assign each appeal to an appeals officer, who shall be responsible for issuing a final determination in accordance with the provisions of the RTKL.
