Pursuant to the Montana Freedom of Information Act, I hereby request the following records:

I request access to all records relating to closed automotive claims for commercial automobile insurance. Each record should include the following elements:

- 17 digit Vehicle Identification Number (VIN) of insured

- 17 digit VIN ID of claimant(s)

- DOT/MC# of insured

- Vehicle make, model, year

- License plate number/state

- Time/date of accident

- Location of accident

- Description of accident

- Record locator/ID for filed police report

- Incurred loss value (property damage)

- Incurred loss value (bodily injury)

- Date claim closed (property damage)

- Date claim closed (bodily injury)

- Was legal suit filed?

- Was case settled or trial?

- Number of fatalities

- Number of injuries

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for your response. Can you please confirm that you are referring to commercial vehicle claims? To be clear, I do NOT seek insurance complaint data, but only commercial automotive closed claims which by definition would contain many of the fields I requested. I would be happy to narrow this request but based on your response it isn't clear that we are referring to the same information.

Dear Ms. Drubi;
Your request for information has been forwarded to me. I have read the attached and below correspondence and I'm thinking that you are not familiar with what the Montana State Auditor's office can offer you in the way of information.
First of all, we are not an insurance company and would not have access to complete claim files of insurers unless that claim file were part of a Consumer Complaint.
Secondly, we do not collect, store, track, or in most cases have access to any documents that would specific vehicle information such as VIN or license plate numbers. In any specific complaint or the response to that complaint provided by the insurer, we may obtain documents that contain specific vehicle information, but that information is not separately entered into any tracking or data system that would allow for the retrieval of just that vehicle information.
Lastly, we are the Office of the Insurance Commissioner, we have records pertaining to Consumer Complaints; we do not generally collect, store, house or in any way maintain a database of insurance claim files.

What you are requesting would require us to manually look through each and every Consumer Complaint that involved a Commercial Auto policy, then examine that complaint page by page to try to extract the information you have requested and we may or may not have. You have not specified the time frame of complaints you are interested in so I have no idea how far back you wish to go, therefore I cannot even provided an educated guess at how many consumer complaint files we may have to manually examine, nor can I provide an estimate of cost to search for the requested information.

If you can possibly explain your purpose in requesting this information, the date range you wish us to search for this information, then I may be able to assist you.

Dear Ms Richetti

Thank you for your response. Several states (Texas and Mass) offer a database of closed auto insurance claims, so I've been inquiring if other states have a similar program, which doesn't seem likely. I'm interested only in commercial claims, so consumer complaints (for personal autos) is outside my scope anyway. Further, complaints are only a small subset of overall claims so it would not serve my purpose.

I'm glad you responded as this request could have otherwise consumed staff time and I understand now you do not possess records pursuant to my request.
