Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:
Related to district HVAC systems for the last five years:
Maintenance records
inspection reports
air quality tests
capital improvement reports for all district schools
As background, this request is filed as part of a journalism project looking at HVAC systems across schools in the United States, and similar requests are being filed in additional school districts.
If you have summary reports or other documents that are likely to include largely similar information and are easier to provide, I’m willing to accept those as a substitute.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

On January 13, 2022, you sent a request for the disclosure of documents from Penn-Harris-Madison School Corporation (“PHM”). We are currently in the process of reviewing our files to determine whether and to what extent PHM has public records responsive to your request. We are also reviewing any such records to determine whether they, in whole or in part, are exempted from the disclosure requirements of the Indiana Access to Public Records Act (“IAPRA”), Ind. Code § 5-14-3-1 et seq.
Please be advised that PHM denies your request to the extent that it includes records exempted from the disclosure requirements of the IAPRA. Such records include, but are not limited to: records declared confidential by state statute (Ind. Code § 5-14-3-4(a)(1))—such as attorney-client privileged communications protected by Ind. Code § 34-46-3-1; records required to be kept confidential by federal law (Ind. Code § 5-14-3-4(a)(3))—such as student records protected by the Federal Education Rights and Privacy Act (“FERPA”), 20 U.S.C. §1232g et seq.; the work product of attorneys representing PHM (Ind. Code § 5-14-3-4(b)(2)(A)); records that are intra-agency or interagency advisory or deliberative material (Ind. Code § 5-14-3-4(b)(6)); information from personnel files of public employees (Ind. Code § 5-14-3-4(b)(8)); and records specifically prepared for discussion in executive session (Ind. Code § 5-14-3-4(b)(12)). I am responsible for denying your request for records, or any portions thereof, that fall within the exceptions of the IAPRA.
